77 relating to the criminal penalty for unlawfully obtaining, lending,
88 possessing, or using a driver's license or personal identification
99 certificate.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 521.451(a), Transportation Code, is
1212 amended to read as follows:
1313 (a) Except as provided by Section 521.452, a person may not:
1414 (1) [display, cause or permit to be displayed, or have
1515 in the person's possession a driver's license or certificate that
1616 the person knows is fictitious or has been altered;
1717 [(2)] lend the person's driver's license or
1818 certificate to another person or knowingly permit another person to
1919 use the person's driver's license or certificate;
2020 (2) [(3)] display or represent as the person's own a
2121 driver's license or certificate not issued to the person; or
2222 (3) [(4)] possess more than one currently valid
2323 driver's license or more than one currently valid certificate [; or
2424 [(5) in an application for an original, renewal, or
2525 duplicate driver's license or certificate:
2626 [(A) provide a false name, false address, or a
2727 counterfeit document; or
2828 [(B) knowingly make a false statement, conceal a
2929 material fact, or otherwise commit fraud].
3030 SECTION 2. Section 521.454(c), Transportation Code, is
3131 amended to read as follows:
3232 (c) An offense under this section is a felony of the third
3333 degree [Class A misdemeanor].
3434 SECTION 3. Section 521.455, Transportation Code, is
3535 repealed.
3636 SECTION 4. The change in law made by this Act applies only
3737 to an offense committed on or after the effective date of this Act.
3838 An offense committed before the effective date of this Act is
3939 covered by the law in effect when the offense was committed, and the
4040 former law is continued in effect for that purpose. For purposes of
4141 this section, an offense was committed before the effective date of
4242 this Act if any element of the offense was committed before that
4343 date.
4444 SECTION 5. This Act takes effect September 1, 2009.
