99 relating to the business leave time account for a police officer
1010 employee organization in certain municipalities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 142.013(d), Local Government Code, is
1313 amended to read as follows:
1414 (d) Donations to the business leave time account of an
1515 employee organization by its members may be authorized in one of the
1616 following ways:
1717 (1) if the majority of the membership of the employee
1818 organization has not affirmatively voted to require contributions
1919 by the employee organization's members to its business leave time
2020 account:
2121 (A) a [The] police officer must authorize the
2222 donation in writing on a form provided by the employee organization
2323 and approved by the municipality; and
2424 (B) after[. After] receiving the signed
2525 authorization on an approved form, the municipality shall transfer
2626 donated time to the account monthly until the municipality receives
2727 the police officer's written revocation of the authorization; or
2828 (2) if the majority of the membership of the employee
2929 organization has affirmatively voted to require contributions by
3030 the employee organization's members to its business leave time
3131 account:
3232 (A) except as provided by Paragraph (C), the
3333 municipality shall transfer donated time to the employee
3434 organization's business leave time account from the accumulated
3535 vacation or compensatory time of each police officer who is a member
3636 of the employee organization in the amount approved by vote of the
3737 employee organization not to exceed the amount allowed under
3838 Subsection (c);
3939 (B) the municipality shall transfer the donated
4040 time to the account monthly beginning with the first calendar month
4141 that begins after the date of the employee organization vote
4242 requiring contributions; and
4343 (C) each year, during the period beginning on the
4444 60th day before the anniversary of the first day of the first
4545 calendar month in which donations were first transferred to the
4646 business leave time account of the employee organization under
4747 Paragraph (B) and ending on the 30th day before that anniversary, a
4848 police officer who is a member of the employee organization may
4949 inform the municipality in writing on a form provided by the
5050 employee organization and approved by the municipality that the
5151 police officer chooses to not donate time to the account during the
5252 12-month period beginning with that anniversary.
5353 SECTION 2. This Act takes effect September 1, 2009.
