10 | 10 | | employee organization in certain municipalities. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 142.013(d), Local Government Code, is |
---|
13 | 13 | | amended to read as follows: |
---|
14 | 14 | | (d) Donations to the business leave time account of an |
---|
15 | 15 | | employee organization by its members may be authorized in one of the |
---|
16 | 16 | | following ways: |
---|
17 | 17 | | (1) if the majority of the membership of the employee |
---|
18 | 18 | | organization has not affirmatively voted to require contributions |
---|
19 | 19 | | by the employee organization's members to its business leave time |
---|
20 | 20 | | account: |
---|
21 | 21 | | (A) a [The] police officer must authorize the |
---|
22 | 22 | | donation in writing on a form provided by the employee organization |
---|
23 | 23 | | and approved by the municipality; and |
---|
24 | 24 | | (B) after[. After] receiving the signed |
---|
25 | 25 | | authorization on an approved form, the municipality shall transfer |
---|
26 | 26 | | donated time to the account monthly until the municipality receives |
---|
27 | 27 | | the police officer's written revocation of the authorization; or |
---|
28 | 28 | | (2) if the majority of the membership of the employee |
---|
29 | 29 | | organization has affirmatively voted to require contributions by |
---|
30 | 30 | | the employee organization's members to its business leave time |
---|
31 | 31 | | account: |
---|
32 | 32 | | (A) except as provided by Paragraph (C), the |
---|
33 | 33 | | municipality shall transfer donated time to the employee |
---|
34 | 34 | | organization's business leave time account from the accumulated |
---|
35 | 35 | | vacation or compensatory time of each police officer who is a member |
---|
36 | 36 | | of the employee organization in the amount approved by vote of the |
---|
37 | 37 | | employee organization not to exceed the amount allowed under |
---|
38 | 38 | | Subsection (c); |
---|
39 | 39 | | (B) the municipality shall transfer the donated |
---|
40 | 40 | | time to the account monthly beginning with the first calendar month |
---|
41 | 41 | | that begins after the date of the employee organization vote |
---|
42 | 42 | | requiring contributions; and |
---|
43 | 43 | | (C) each year, during the period beginning on the |
---|
44 | 44 | | 60th day before the anniversary of the first day of the first |
---|
45 | 45 | | calendar month in which donations were first transferred to the |
---|
46 | 46 | | business leave time account of the employee organization under |
---|
47 | 47 | | Paragraph (B) and ending on the 30th day before that anniversary, a |
---|
48 | 48 | | police officer who is a member of the employee organization may |
---|
49 | 49 | | inform the municipality in writing on a form provided by the |
---|
50 | 50 | | employee organization and approved by the municipality that the |
---|
51 | 51 | | police officer chooses to not donate time to the account during the |
---|
52 | 52 | | 12-month period beginning with that anniversary. |
---|
53 | 53 | | SECTION 2. This Act takes effect September 1, 2009. |
