66 AN ACT
77 relating to the establishment of an interoperable statewide
88 emergency radio infrastructure and the establishment of an
99 emergency radio infrastructure account.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 771, Health and Safety Code, is amended
1212 by adding Subchapter F to read as follows:
1313 SUBCHAPTER F. INTEROPERABLE STATEWIDE EMERGENCY
1414 RADIO INFRASTRUCTURE
1515 Sec. 771.151. DEFINITION. In this subchapter, "emergency
1616 radio infrastructure" means radio frequency hardware, software, or
1717 auxiliary equipment that:
1818 (1) provides dispatch communications for this state
1919 and local governments to public safety agencies; and
2020 (2) permits interoperable communication between
2121 different public safety agencies.
2222 Sec. 771.152. USE OF REVENUE. (a) Fees collected under
2323 Section 133.102(e)(7), Local Government Code, may only:
2424 (1) be used for the planning, development, provision,
2525 enhancement, or ongoing maintenance of an interoperable statewide
2626 emergency radio infrastructure;
2727 (2) be used in accordance with the state
2828 communications interoperability plan;
2929 (3) be used for the development of a regional or state
3030 interoperable radio communication system; or
3131 (4) be distributed as grants by the commission to:
3232 (A) regional councils of government that have
3333 entered into interlocal agreements authorized under state law; and
3434 (B) state agencies requiring emergency radio
3535 communications infrastructure.
3636 (b) Fees collected and distributed as provided by this
3737 subchapter may not be used to purchase or maintain radio subscriber
3838 equipment.
3939 Sec. 771.153. EMERGENCY RADIO INFRASTRUCTURE ACCOUNT. (a)
4040 The emergency radio infrastructure account is an account in the
4141 general revenue fund.
4242 (b) The account consists of:
4343 (1) fees deposited in the fund as provided by Section
4444 133.102(e)(7), Local Government Code; and
4545 (2) notwithstanding Section 404.071, Government Code,
4646 all interest attributable to money held in the account.
4747 (c) Money in the account may be appropriated to:
4848 (1) the commission for the planning, development,
4949 provision, enhancement, or ongoing maintenance of an interoperable
5050 statewide emergency radio infrastructure; and
5151 (2) the Department of Public Safety for communications
5252 interoperability and other public safety services.
5353 (d) Section 403.095, Government Code, does not apply to the
5454 account.
5555 SECTION 2. Section 133.102(e), Local Government Code, is
5656 amended to read as follows:
5757 (e) The comptroller shall allocate the court costs received
5858 under this section to the following accounts and funds so that each
5959 receives to the extent practicable, utilizing historical data as
6060 applicable, the same amount of money the account or fund would have
6161 received if the court costs for the accounts and funds had been
6262 collected and reported separately, except that the account or fund
6363 may not receive less than the following percentages:
6464 (1) abused children's counseling0.0088 percent;
6565 (2) crime stoppers assistance0.2581 percent;
6666 (3) breath alcohol testing0.5507 percent;
6767 (4) Bill Blackwood Law Enforcement Management
6868 Institute2.1683 percent;
6969 (5) law enforcement officers standards and
7070 education5.0034 percent;
7171 (6) comprehensive rehabilitation5.3218 percent;
7272 (7) emergency radio infrastructure account
7373 [operator's and chauffeur's license]23.2330 [11.1426] percent;
7474 (8) criminal justice planning12.5537 percent;
7575 (9) an account in the state treasury to be used only
7676 for the establishment and operation of the Center for the Study and
7777 Prevention of Juvenile Crime and Delinquency at Prairie View A&M

7979 (10) compensation to victims of crime
