| 5 | 5 | | relating to the payment of a lottery prize awarded to a minor. |

| 6 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 7 | | SECTION 1. Sections 466.405(b) and (e), Government Code, |
|---|
| 8 | 8 | | are amended to read as follows: |
|---|
| 9 | 9 | | (b) If a minor is entitled to prize money on a winning ticket |
|---|
| 10 | 10 | | in an amount of $600 or more, the director may direct payment to the |
|---|
| 11 | 11 | | minor by depositing the amount of the prize in any financial |
|---|
| 12 | 12 | | institution [bank] to the credit of an adult member of the minor's |
|---|
| 13 | 13 | | family or of the minor's guardian as custodian for the minor. |
|---|
| 14 | 14 | | (e) In this section: |
|---|
| 15 | 15 | | (1) "Adult" means an individual who is at least 18 |
|---|
| 16 | 16 | | years of age. |
|---|
| 17 | 17 | | (2) "Custodian," "financial institution," [, "adult," |
|---|
| 18 | 18 | | "bank," "custodian,"] "guardian," and "member of the [a] minor's |
|---|
| 19 | 19 | | family," [and "minor"] have the meanings assigned by Section |
|---|
| 20 | 20 | | 141.002, Property Code. |
|---|
| 21 | 21 | | (3) "Minor" means an individual who is younger than 18 |
|---|
| 22 | 22 | | years of age. |
|---|
| 23 | 23 | | SECTION 2. This Act takes effect September 1, 2009. |
