66 AN ACT
77 relating to the use of alternative fuels by a county mass transit
88 authority.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 457.201, Transportation Code, is amended
1111 by amending Subsections (a) and (b) and adding Subsection (d) to
1212 read as follows:
1313 (a) An authority may not purchase or lease a motor vehicle
1414 that is not capable of using compressed natural gas, liquefied
1515 natural gas, liquefied petroleum gas, methanol, a
1616 methanol-gasoline blend of at least 85 percent, ethanol, an
1717 ethanol-gasoline blend of at least 85 percent, or electricity, or
1818 another alternative fuel the use of which results in comparably
1919 lower emissions of oxides of nitrogen, volatile organic compounds,
2020 carbon monoxide, or particulates or combinations of those
2121 materials.
2222 (b) Each motor vehicle purchased or leased by the authority
2323 must use an alternative fuel 80 percent of the time the vehicle is
2424 in operation. [At least 50 percent of the fleet vehicles operated
2525 by an authority must be capable of using compressed natural gas or
2626 another alternative fuel.]
2727 (d) Not later than December 1 of each year, an authority
2828 shall submit a report to the legislature that details the
2929 authority's progress in achieving the percentage requirements of
3030 this section by:
3131 (1) itemizing purchases, leases, and conversions of
3232 motor vehicles;
3333 (2) itemizing usage of compressed natural gas,
3434 liquefied natural gas, liquefied petroleum gas, methanol, a
3535 methanol-gasoline blend of at least 85 percent, ethanol, an
3636 ethanol-gasoline blend of at least 85 percent, or electricity; and
3737 (3) describing the availability of compressed natural
3838 gas, liquefied natural gas, liquefied petroleum gas, methanol, a
3939 methanol-gasoline blend of at least 85 percent, ethanol, an
4040 ethanol-gasoline blend of at least 85 percent, or electricity.
4141 SECTION 2. This Act takes effect September 1, 2009.
