| 10 | 10 | SECTION 1. Subchapter H, Chapter 201, Transportation Code, | |
| 11 | 11 | is amended by adding Section 201.622 to read as follows: | |
| 12 | 12 | Sec. 201.622. EVALUATION FOR TOLLING NOT REQUIRED. The | |
| 13 | 13 | commission may not require that each highway or other mobility | |
| 14 | 14 | project that is proposed, in development, or under construction be | |
| 15 | 15 | evaluated for tolling. | |
| 16 | 16 | SECTION 2. This Act takes effect immediately if it receives | |
| 17 | 17 | a vote of two-thirds of all the members elected to each house, as | |
| 18 | 18 | provided by Section 39, Article III, Texas Constitution. If this | |
| 19 | 19 | Act does not receive the vote necessary for immediate effect, this | |
| 20 | 20 | Act takes effect September 1, 2009. |
