55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to establishing an interim committee to study the
88 provision of dental services to certain public school students.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. (a) The Interim Select Committee on Dental
1111 Services for Public School Students is established to study the
1212 advisability and feasibility of requiring dental examinations for
1313 public school students who are entering the first grade. The
1414 committee's study must include an analysis of:
1515 (1) the advantages and disadvantages of requiring a
1616 dental examination performed by a dentist for each student not
1717 earlier than the 180th day before or later than the 30th day after
1818 the date the student enters the first grade; and
1919 (2) the costs associated with requiring a dental
2020 examination as described by Subdivision (1) of this subsection.
2121 (b) The committee is composed of 10 members appointed as
2222 follows:
2323 (1) three members appointed by the lieutenant
2424 governor, two of whom must be senators and the other one of whom
2525 must be a nonelected individual who holds a license under Subtitle
2626 D, Title 3, Occupations Code;
2727 (2) three members appointed by the speaker of the
2828 house of representatives, two of whom must be members of the house
2929 and the other one of whom must be a nonelected individual who holds
3030 a license under Subtitle D, Title 3, Occupations Code;
3131 (3) three members appointed by the governor, one of
3232 whom must be a nonelected individual who holds a license under
3333 Subtitle D, Title 3, Occupations Code, and the other two of whom may
3434 not be employed by a governmental entity; and
3535 (4) one member, appointed by the executive director of
3636 the State Board of Dental Examiners, who may not be employed by a
3737 governmental entity.
3838 (c) Not later than December 1, 2009, the committee shall
3939 hold an organizational meeting. At that meeting, the committee
4040 shall elect a presiding officer from among its members. Committee
4141 meetings shall be held at the call of the presiding officer.
4242 (d) The committee has all other powers and duties provided
4343 to a special or select committee by the rules of the senate and
4444 house of representatives, by Subchapter B, Chapter 301, Government
4545 Code, and by policies of the senate and house committees on
4646 administration.
4747 (e) From the contingent expense fund of the senate and the
4848 contingent expense fund of the house of representatives equally,
4949 the members of the committee are entitled to reimbursement for
5050 expenses incurred in carrying out this Act in accordance with the
5151 rules of the senate and house of representatives and the policies of
5252 the senate and house committees on administration.
5353 (f) Not later than February 1, 2011, the committee shall
5454 report the committee's findings and recommendations resulting from
5555 the study to the governor, lieutenant governor, the speaker of the
5656 house of representatives, and the members of the legislature.
5757 SECTION 2. Not later than November 1, 2009, the lieutenant
5858 governor, the speaker of the house of representatives, and the
5959 governor shall appoint members to the Interim Select Committee on
6060 Dental Services for Public School Students established under
6161 Section 1 of this Act.
6262 SECTION 3. This Act takes effect September 1, 2009.
