6	6	AN ACT
7	7	relating to establishing an interim committee to study the
8	8	provision of dental services to certain public school students.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. (a) The Interim Select Committee on Dental
11	11	Services for Public School Students is established to study the
12	12	advisability and feasibility of requiring dental examinations for
13	13	public school students who are entering the first grade. The
14	14	committee's study must include an analysis of:
15	15	(1) the advantages and disadvantages of requiring a
16	16	dental examination performed by a dentist for each student not
17	17	earlier than the 180th day before or later than the 30th day after
18	18	the date the student enters the first grade; and
19	19	(2) the costs associated with requiring a dental
20	20	examination as described by Subdivision (1) of this subsection.
21	21	(b) The committee is composed of 10 members appointed as
22	22	follows:
23	23	(1) three members appointed by the lieutenant
24	24	governor, two of whom must be senators and the other one of whom
25	25	must be a nonelected individual who holds a license under Subtitle
26	26	D, Title 3, Occupations Code;
27	27	(2) three members appointed by the speaker of the
28	28	house of representatives, two of whom must be members of the house
29	29	and the other one of whom must be a nonelected individual who holds
30	30	a license under Subtitle D, Title 3, Occupations Code;
31	31	(3) three members appointed by the governor, one of
32	32	whom must be a nonelected individual who holds a license under
33	33	Subtitle D, Title 3, Occupations Code, and the other two of whom may
34	34	not be employed by a governmental entity; and
35	35	(4) one member, appointed by the executive director of
36	36	the State Board of Dental Examiners, who may not be employed by a
37	37	governmental entity.
38	38	(c) Not later than December 1, 2009, the committee shall
39	39	hold an organizational meeting. At that meeting, the committee
40	40	shall elect a presiding officer from among its members. Committee
41	41	meetings shall be held at the call of the presiding officer.
42	42	(d) The committee has all other powers and duties provided
43	43	to a special or select committee by the rules of the senate and
44	44	house of representatives, by Subchapter B, Chapter 301, Government
45	45	Code, and by policies of the senate and house committees on
46	46	administration.
47	47	(e) From the contingent expense fund of the senate and the
48	48	contingent expense fund of the house of representatives equally,
49	49	the members of the committee are entitled to reimbursement for
50	50	expenses incurred in carrying out this Act in accordance with the
51	51	rules of the senate and house of representatives and the policies of
52	52	the senate and house committees on administration.
53	53	(f) Not later than February 1, 2011, the committee shall
54	54	report the committee's findings and recommendations resulting from
55	55	the study to the governor, lieutenant governor, the speaker of the
56	56	house of representatives, and the members of the legislature.
57	57	SECTION 2. Not later than November 1, 2009, the lieutenant
58	58	governor, the speaker of the house of representatives, and the
59	59	governor shall appoint members to the Interim Select Committee on
60	60	Dental Services for Public School Students established under
61	61	Section 1 of this Act.
62	62	SECTION 3. This Act takes effect September 1, 2009.
