55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to school district reporting of students placed in
88 disciplinary alternative education programs or expelled from
99 school.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 37.020, Education Code, is amended by
1212 amending Subsections (b) and (c) and adding Subsection (d) to read
1313 as follows:
1414 (b) For each placement in a disciplinary alternative
1515 education program established under Section 37.008, the district
1616 shall report:
1717 (1) information identifying the student, including
1818 the student's race, sex, and date of birth, that will enable the
1919 agency to compare placement data with information collected through
2020 other reports;
2121 (2) information indicating whether the student was
2222 enrolled in a special education program under Subchapter A, Chapter
2323 29, at the time of the placement;
2424 (3) information indicating whether the placement was
2525 based on:
2626 (A) conduct violating the student code of conduct
2727 adopted under Section 37.001;
2828 (B) conduct for which a student may be removed
2929 from class under Section 37.002(b);
3030 (C) conduct for which placement in a disciplinary
3131 alternative education program is required by Section 37.006; or
3232 (D) conduct occurring while a student was
3333 enrolled in another district and for which placement in a
3434 disciplinary alternative education program is permitted by Section
3535 37.008(j);
3636 (4) [(3)] the number of full or partial days the
3737 student was assigned to the program and the number of full or
3838 partial days the student attended the program; and
3939 (5) [(4)] the number of placements that were
4040 inconsistent with the guidelines included in the student code of
4141 conduct under Section 37.001(a)(5).
4242 (c) For each expulsion under Section 37.007, the district
4343 shall report:
4444 (1) information identifying the student, including
4545 the student's race, sex, and date of birth, that will enable the
4646 agency to compare placement data with information collected through
4747 other reports;
4848 (2) information indicating whether the student was
4949 enrolled in a special education program under Subchapter A, Chapter
5050 29, at the time of the expulsion;
5151 (3) information indicating whether the expulsion was
5252 based on:
5353 (A) conduct for which expulsion is required under
5454 Section 37.007, including information specifically indicating
5555 whether a student was expelled on the basis of Section 37.007(e); or
5656 (B) conduct for which expulsion is permitted
5757 under Section 37.007;
5858 (4) [(3)] the number of full or partial days the
5959 student was expelled;
6060 (5) [(4)] information indicating whether:
6161 (A) the student was placed in a juvenile justice
6262 alternative education program under Section 37.011;
6363 (B) the student was placed in a disciplinary
6464 alternative education program; or
6565 (C) the student was not placed in a juvenile
6666 justice or other disciplinary alternative education program; and
6767 (6) [(5)] the number of expulsions that were
6868 inconsistent with the guidelines included in the student code of
6969 conduct under Section 37.001(a)(5).
7070 (d) For each circumstance in which a student engages in
7171 conduct for which the student is subject to expulsion under Section
7272 37.007(a), (d), or (e), but in which the district does not expel the
7373 student because the student's incarceration or other circumstance
7474 prevents the district from taking that action, the district shall
7575 report information:
7676 (1) identifying the student, including the student's
7777 race, sex, and date of birth;
7878 (2) indicating whether the student was enrolled in a
7979 special education program under Subchapter A, Chapter 29, at the
8080 time of the conduct;
8181 (3) describing the conduct in which the student
8282 engaged; and
8383 (4) specifying the incarceration or other disposition
8484 that resulted from the student's conduct.
8585 SECTION 2. This Act applies beginning with the 2009-2010
8686 school year.
8787 SECTION 3. This Act takes effect immediately if it receives
8888 a vote of two-thirds of all the members elected to each house, as
8989 provided by Section 39, Article III, Texas Constitution. If this
9090 Act does not receive the vote necessary for immediate effect, this
9191 Act takes effect September 1, 2009.
