11 | 11 | | authorization by a licensed nurse practitioner or a physician |

12 | 12 | | assistant. |

13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Section 32.067, Human Resources Code, is amended |
---|
15 | 15 | | by adding Subsection (c) to read as follows: |
---|
16 | 16 | | (c) The department shall ensure that a licensed nurse |
---|
17 | 17 | | practitioner or a physician assistant is permitted to authorize the |
---|
18 | 18 | | provision of private duty nursing and therapy services to |
---|
19 | 19 | | individuals through the Texas Health Steps Comprehensive Care |
---|
20 | 20 | | Program, to the extent that a nurse practitioner or physician |
---|
21 | 21 | | assistant is permitted to authorize those services under Chapter |
---|
22 | 22 | | 142, Health and Safety Code, Chapter 157, Occupations Code, or |
---|
23 | 23 | | federal law. |

24 | 24 | | SECTION 2. If before implementing any provision of this Act |
---|
25 | 25 | | a state agency determines that a waiver or authorization from a |
---|
26 | 26 | | federal agency is necessary for implementation of that provision, |
---|
27 | 27 | | the agency affected by the provision shall request the waiver or |
---|
28 | 28 | | authorization and may delay implementing that provision until the |
---|
29 | 29 | | waiver or authorization is granted. |
---|
30 | 30 | | SECTION 3. This Act takes effect September 1, 2009. |
