| 11 | 11 | | authorization by a licensed nurse practitioner or a physician |
|---|
| 12 | 12 | | assistant. |

| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Section 32.067, Human Resources Code, is amended |
|---|
| 15 | 15 | | by adding Subsection (c) to read as follows: |
|---|
| 16 | 16 | | (c) The department shall ensure that a licensed nurse |
|---|
| 17 | 17 | | practitioner or a physician assistant is permitted to authorize the |
|---|
| 18 | 18 | | provision of private duty nursing and therapy services to |
|---|
| 19 | 19 | | individuals through the Texas Health Steps Comprehensive Care |
|---|
| 20 | 20 | | Program, to the extent that a nurse practitioner or physician |
|---|
| 21 | 21 | | assistant is permitted to authorize those services under Chapter |
|---|
| 22 | 22 | | 142, Health and Safety Code, Chapter 157, Occupations Code, or |
|---|
| 23 | 23 | | federal law. |
|---|
| 24 | 24 | | SECTION 2. If before implementing any provision of this Act |
|---|
| 25 | 25 | | a state agency determines that a waiver or authorization from a |
|---|
| 26 | 26 | | federal agency is necessary for implementation of that provision, |
|---|
| 27 | 27 | | the agency affected by the provision shall request the waiver or |
|---|
| 28 | 28 | | authorization and may delay implementing that provision until the |
|---|
| 29 | 29 | | waiver or authorization is granted. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2009. |
|---|
