88 AN ACT
99 relating to the provision of private duty nursing and therapy
1010 services under the Medicaid program in accordance with
1111 authorization by a licensed nurse practitioner or a physician
1212 assistant.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 32.067, Human Resources Code, is amended
1515 by adding Subsection (c) to read as follows:
1616 (c) The department shall ensure that a licensed nurse
1717 practitioner or a physician assistant is permitted to authorize the
1818 provision of private duty nursing and therapy services to
1919 individuals through the Texas Health Steps Comprehensive Care
2020 Program, to the extent that a nurse practitioner or physician
2121 assistant is permitted to authorize those services under Chapter
2222 142, Health and Safety Code, Chapter 157, Occupations Code, or
2323 federal law.
2424 SECTION 2. If before implementing any provision of this Act
2525 a state agency determines that a waiver or authorization from a
2626 federal agency is necessary for implementation of that provision,
2727 the agency affected by the provision shall request the waiver or
2828 authorization and may delay implementing that provision until the
2929 waiver or authorization is granted.
3030 SECTION 3. This Act takes effect September 1, 2009.
