 A BILL TO BE ENTITLED
 AN ACT
 relating to the provision of private duty nursing and therapy
 services under the Medicaid program in accordance with
 authorization by a licensed nurse practitioner or a physician
 assistant.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 32.067, Human Resources Code, is amended
 by adding Subsection (c) to read as follows:
 (c)  The department shall ensure that a licensed nurse
 practitioner or a physician assistant is permitted to authorize the
 provision of private duty nursing and therapy services to
 individuals through the Texas Health Steps Comprehensive Care
 Program, to the extent that a nurse practitioner or physician
 assistant is permitted to authorize those services under Chapter
 142, Health and Safety Code, Chapter 157, Occupations Code, or
 federal law.
 SECTION 2. If before implementing any provision of this Act
 a state agency determines that a waiver or authorization from a
 federal agency is necessary for implementation of that provision,
 the agency affected by the provision shall request the waiver or
 authorization and may delay implementing that provision until the
 waiver or authorization is granted.
 SECTION 3. This Act takes effect September 1, 2009.
