9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter Z, Chapter 130, Local Government | |
11 | 11 | Code, is amended by adding Section 130.910 to read as follows: | |
12 | 12 | Sec. 130.910. NONBINDING REFERENDUM ON COUNTY FISCAL | |
13 | 13 | MATTER. (a) The commissioners court of a county may hold a | |
14 | 14 | nonbinding referendum in the county on any question affecting a | |
15 | 15 | county fiscal matter other than a matter involving: | |
16 | 16 | (1) a labor agreement; or | |
17 | 17 | (2) compensation of any county employee. | |
18 | 18 | (b) The referendum shall be held in the same manner as an | |
19 | 19 | election on a county measure and must take place on an election date | |
20 | 20 | authorized by Section 41.001, Election Code. | |
21 | 21 | SECTION 2. This Act takes effect immediately if it receives | |
22 | 22 | a vote of two-thirds of all the members elected to each house, as | |
23 | 23 | provided by Section 39, Article III, Texas Constitution. If this | |
24 | 24 | Act does not receive the vote necessary for immediate effect, this | |
25 | 25 | Act takes effect September 1, 2009. |
