77 relating to allowing a county to hold a nonbinding referendum on a
88 county fiscal matter.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 130, Local Government
1111 Code, is amended by adding Section 130.910 to read as follows:
1212 Sec. 130.910. NONBINDING REFERENDUM ON COUNTY FISCAL
1313 MATTER. (a) The commissioners court of a county may hold a
1414 nonbinding referendum in the county on any question affecting a
1515 county fiscal matter other than a matter involving:
1616 (1) a labor agreement; or
1717 (2) compensation of any county employee.
1818 (b) The referendum shall be held in the same manner as an
1919 election on a county measure and must take place on an election date
2020 authorized by Section 41.001, Election Code.
2121 SECTION 2. This Act takes effect immediately if it receives
2222 a vote of two-thirds of all the members elected to each house, as
2323 provided by Section 39, Article III, Texas Constitution. If this
2424 Act does not receive the vote necessary for immediate effect, this
2525 Act takes effect September 1, 2009.
