 A BILL TO BE ENTITLED
 AN ACT
 relating to allowing a county to hold a nonbinding referendum on a
 county fiscal matter.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Subchapter Z, Chapter 130, Local Government
 Code, is amended by adding Section 130.910 to read as follows:
 Sec. 130.910. NONBINDING REFERENDUM ON COUNTY FISCAL
 MATTER. (a)  The commissioners court of a county may hold a
 nonbinding referendum in the county on any question affecting a
 county fiscal matter other than a matter involving:
 (1) a labor agreement; or
 (2) compensation of any county employee.
 (b)  The referendum shall be held in the same manner as an
 election on a county measure and must take place on an election date
 authorized by Section 41.001, Election Code.
 SECTION 2. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
