88 A BILL TO BE ENTITLED
99 AN ACT
1010 relating to indigent health care services that may be provided by a
1111 county.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 61.0285(a), Health and Safety Code, is
1414 amended to read as follows:
1515 (a) In addition to basic health care services provided under
1616 Section 61.028, a county may, in accordance with department rules
1717 adopted under Section 61.006, provide other medically necessary
1818 services or supplies that the county determines to be
1919 cost-effective, including:
2020 (1) ambulatory surgical center services;
2121 (2) diabetic and colostomy medical supplies and
2222 equipment;
2323 (3) durable medical equipment;
2424 (4) home and community health care services;
2525 (5) social work services;
2626 (6) psychological counseling services;
2727 (7) services provided by physician assistants, nurse
2828 practitioners, certified nurse midwives, clinical nurse
2929 specialists, and certified registered nurse anesthetists;
3030 (8) dental care;
3131 (9) vision care, including eyeglasses;
3232 (10) services provided by federally qualified health
3333 centers, as defined by 42 U.S.C. Section 1396d(l)(2)(B);
3434 (11) emergency medical services; [and]
3535 (12) physical and occupational therapy services; and
3636 (13) any other appropriate health care service
3737 identified by department [board] rule that may be determined to be
3838 cost-effective.
3939 SECTION 2. The executive commissioner of the Health and
4040 Human Services Commission shall adopt rules necessary to implement
4141 Section 61.0285, Health and Safety Code, as amended by this Act, as
4242 soon as practicable after the effective date of this Act.
4343 SECTION 3. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2009.
