77 relating to the regulation of signs by municipalities.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 216.901, Local Government Code, is
1010 amended to read as follows:
1111 Sec. 216.901. REGULATION OF SIGNS BY [HOME-RULE]
1212 MUNICIPALITY. (a) A [home-rule] municipality may license,
1313 regulate, control, or prohibit the erection of signs or billboards
1414 by charter or ordinance.
1515 (b) Subsection (a) does not authorize a municipality to
1616 regulate the relocation, reconstruction, or removal of a sign in
1717 violation of Subchapter A.
1818 SECTION 2. This Act takes effect immediately if it receives
1919 a vote of two-thirds of all the members elected to each house, as
2020 provided by Section 39, Article III, Texas Constitution. If this
2121 Act does not receive the vote necessary for immediate effect, this
2222 Act takes effect September 1, 2009.
