8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 216.901, Local Government Code, is | |
10 | 10 | amended to read as follows: | |
11 | 11 | Sec. 216.901. REGULATION OF SIGNS BY [HOME-RULE] | |
12 | 12 | MUNICIPALITY. (a) A [home-rule] municipality may license, | |
13 | 13 | regulate, control, or prohibit the erection of signs or billboards | |
14 | 14 | by charter or ordinance. | |
15 | 15 | (b) Subsection (a) does not authorize a municipality to | |
16 | 16 | regulate the relocation, reconstruction, or removal of a sign in | |
17 | 17 | violation of Subchapter A. | |
18 | 18 | SECTION 2. This Act takes effect immediately if it receives | |
19 | 19 | a vote of two-thirds of all the members elected to each house, as | |
20 | 20 | provided by Section 39, Article III, Texas Constitution. If this | |
21 | 21 | Act does not receive the vote necessary for immediate effect, this | |
22 | 22 | Act takes effect September 1, 2009. |
