 A BILL TO BE ENTITLED
 AN ACT
 relating to the regulation of signs by municipalities.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 216.901, Local Government Code, is
 amended to read as follows:
 Sec. 216.901. REGULATION OF SIGNS BY [HOME-RULE]
 MUNICIPALITY. (a) A [home-rule] municipality may license,
 regulate, control, or prohibit the erection of signs or billboards
 by charter or ordinance.
 (b) Subsection (a) does not authorize a municipality to
 regulate the relocation, reconstruction, or removal of a sign in
 violation of Subchapter A.
 SECTION 2. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
