66 AN ACT
77 relating to the issuance of an original or renewal driver's license
88 to certain persons younger than 18 years of age.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter M, Chapter 521, Transportation Code,
1111 is amended by adding Section 521.2735 to read as follows:
1212 Sec. 521.2735. ORIGINAL OR RENEWAL LICENSE ISSUED TO HOLDER
1313 OF PROVISIONAL LICENSE. Notwithstanding Section 521.273, the
1414 department may not issue an original or renewal license to an
1515 applicant who is at least 17 years of age and holds a provisional
1616 license unless the applicant provides evidence satisfactory to the
1717 department that in the 180 days preceding the date of application
1818 the applicant has successfully completed a driver education course
1919 approved by the department, which may be a course approved under
2020 Section 521.205.
2121 SECTION 2. The changes in law made by this Act apply only to
2222 an application for an original or renewal driver's license filed on
2323 or after the effective date of this Act. An application for an
2424 original or renewal driver's license filed before the effective
2525 date of this Act is subject to the law in effect on the date the
2626 application was filed, and the former law is continued in effect for
2727 that purpose.
2828 SECTION 3. This Act takes effect September 1, 2009.
