9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter M, Chapter 521, Transportation Code, | |
11 | 11 | is amended by adding Section 521.2735 to read as follows: | |
12 | 12 | Sec. 521.2735. ORIGINAL OR RENEWAL LICENSE ISSUED TO HOLDER | |
13 | 13 | OF PROVISIONAL LICENSE. Notwithstanding Section 521.273, the | |
14 | 14 | department may not issue an original or renewal license to an | |
15 | 15 | applicant who is at least 17 years of age and holds a provisional | |
16 | 16 | license unless the applicant provides evidence satisfactory to the | |
17 | 17 | department that in the 180 days preceding the date of application | |
18 | 18 | the applicant has successfully completed a driver education course | |
19 | 19 | approved by the department, which may be a course approved under | |
20 | 20 | Section 521.205. | |
21 | 21 | SECTION 2. The changes in law made by this Act apply only to | |
22 | 22 | an application for an original or renewal driver's license filed on | |
23 | 23 | or after the effective date of this Act. An application for an | |
24 | 24 | original or renewal driver's license filed before the effective | |
25 | 25 | date of this Act is subject to the law in effect on the date the | |
26 | 26 | application was filed, and the former law is continued in effect for | |
27 | 27 | that purpose. | |
28 | 28 | SECTION 3. This Act takes effect September 1, 2009. |
