77 relating to electric utility energy efficiency goals.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 39.905, Utilities Code, is amended by
1010 amending Subsection (a) and adding Subsection (a-1) to read as
1111 follows:
1212 (a) It is the goal of the legislature that:
1313 (1) electric utilities will administer energy
1414 efficiency incentive programs in a market-neutral,
1515 nondiscriminatory manner but will not offer underlying competitive
1616 services;
1717 (2) all customers, in all customer classes, will have
1818 a choice of and access to energy efficiency alternatives and other
1919 choices from the market that allow each customer to reduce energy
2020 consumption, peak demand, or energy costs;
2121 (3) each electric utility will provide, through
2222 market-based standard offer programs or limited, targeted,
2323 market-transformation programs, incentives sufficient for retail
2424 electric providers and competitive energy service providers to
2525 acquire additional cost-effective energy efficiency for
2626 residential and commercial customers equivalent to at least:
2727 (A) 30 [10] percent of the electric utility's
2828 annual growth in demand of residential and commercial customers by
2929 December 31, 2011 [2007];
3030 (B) 40 [15] percent of the electric utility's
3131 annual growth in demand of residential and commercial customers by
3232 December 31, 2013 [2008, provided that the electric utility's
3333 program expenditures for 2008 funding may not be greater than 75
3434 percent above the utility's program budget for 2007 for residential
3535 and commercial customers, as included in the April 1, 2006,
3636 filing]; and
3737 (C) 50 [20] percent of the electric utility's
3838 annual growth in demand of residential and commercial customers by
3939 December 31, 2015 [2009, provided that the electric utility's
4040 program expenditures for 2009 funding may not be greater than 150
4141 percent above the utility's program budget for 2007 for residential
4242 and commercial customers, as included in the April 1, 2006,
4343 filing];
4444 (4) each electric utility in the ERCOT region shall
4545 use its best efforts to encourage and facilitate the involvement of
4646 the region's retail electric providers in the delivery of
4747 efficiency programs and demand response programs under this
4848 section;
4949 (5) retail electric providers in the ERCOT region, and
5050 electric utilities outside of the ERCOT region, shall provide
5151 customers with energy efficiency educational materials; and
5252 (6) notwithstanding Subsection (a)(3), electric
5353 utilities shall continue to make available, at 2007 funding and
5454 participation levels, any load management standard offer programs
5555 developed for industrial customers and implemented prior to May 1,
5656 2007.
5757 (a-1) It is the goal of the legislature that, beginning with
5858 the year ending December 31, 2016, each electric utility will
5959 provide incentives sufficient for retail electric providers and
6060 competitive energy service providers to acquire additional
6161 cost-effective energy efficiency for all customers, in all
6262 categories, to the extent that the total annual energy consumption
6363 in this state is reduced by two percent each year.
6464 SECTION 2. This Act takes effect immediately if it receives
6565 a vote of two-thirds of all the members elected to each house, as
6666 provided by Section 39, Article III, Texas Constitution. If this
6767 Act does not receive the vote necessary for immediate effect, this
6868 Act takes effect September 1, 2009.
