55 relating to contracts by governmental entities for professional
66 services relating to geoscience and landscape architecture.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 2254.002(2), Government Code, is amended
99 to read as follows:
1010 (2) "Professional services" means services:
1111 (A) within the scope of the practice, as defined
1212 by state law, of:
1313 (i) accounting;
1414 (ii) architecture;
1515 (iii) landscape architecture;
1616 (iv) land surveying;
1717 (v) medicine;
1818 (vi) optometry;
1919 (vii) professional engineering;
2020 (viii) real estate appraising; [or]
2121 (ix) professional nursing; or
2222 (x) professional geoscience; or
2323 (B) provided in connection with the professional
2424 employment or practice of a person who is licensed or registered as:
2525 (i) a certified public accountant;
2626 (ii) an architect;
2727 (iii) a landscape architect;
2828 (iv) a land surveyor;
2929 (v) a physician, including a surgeon;
3030 (vi) an optometrist;
3131 (vii) a professional engineer;
3232 (viii) a state certified or state licensed
3333 real estate appraiser; [or]
3434 (ix) a registered nurse; or
3535 (x) a professional geoscientist.
3636 SECTION 2. The heading to Section 2254.004, Government
3737 Code, is amended to read as follows:
3838 Sec. 2254.004. CONTRACT FOR PROFESSIONAL SERVICES OF
3939 ARCHITECT, ENGINEER, [OR] SURVEYOR, LANDSCAPE ARCHITECT, OR
4040 GEOSCIENTIST.
4141 SECTION 3. Sections 2254.004(a) and (b), Government Code,
4242 are amended to read as follows:
4343 (a) In procuring architectural, engineering, [or] land
4444 surveying, landscape architectural, or geoscientific services, a
4545 governmental entity shall:
4646 (1) first select the most highly qualified provider of
4747 those services on the basis of demonstrated competence and
4848 qualifications; and
4949 (2) then attempt to negotiate with that provider a
5050 contract at a fair and reasonable price.
5151 (b) If a satisfactory contract cannot be negotiated with the
5252 most highly qualified provider of architectural, engineering, [or]
5353 land surveying, landscape architectural, or geoscientific
5454 services, the entity shall:
5555 (1) formally end negotiations with that provider;
5656 (2) select the next most highly qualified provider;
5757 and
5858 (3) attempt to negotiate a contract with that provider
5959 at a fair and reasonable price.
6060 SECTION 4. The changes in law made by this Act apply only to
6161 the selection of a provider of professional geoscientific services
6262 or the award of a contract to provide professional geoscientific
6363 services made on or after October 1, 2009.
6464 SECTION 5. This Act takes effect September 1, 2009.
