| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 37.006(f), Education Code, is amended to | |
| 12 | 12 | read as follows: | |
| 13 | 13 | (f) Subject to Section 37.007(e), a student who is younger | |
| 14 | 14 | than 10 years of age shall be removed from class and placed in a | |
| 15 | 15 | disciplinary alternative education program under Section 37.008 if | |
| 16 | 16 | the student engages in conduct described by Section 37.007(a) or | |
| 17 | 17 | (d) that requires expulsion of a student who is at least 10 years of | |
| 18 | 18 | age [37.007]. An elementary school student may not be placed in a | |
| 19 | 19 | disciplinary alternative education program with any other student | |
| 20 | 20 | who is not an elementary school student. | |
| 21 | 21 | SECTION 2. This Act applies beginning with the 2009-2010 | |
| 22 | 22 | school year. | |
| 23 | 23 | SECTION 3. This Act takes effect immediately if it receives | |
| 24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
| 25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
| 26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
| 27 | 27 | Act takes effect September 1, 2009. |
