55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to notice of the leave policies of a school district to
88 district employees.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 22, Education Code, is
1111 amended by adding Section 22.008 to read as follows:
1212 Sec. 22.008. NOTICE OF LEAVE POLICY. (a) A school district
1313 shall provide written notice to any district employee regarding the
1414 types of leave the employee is entitled to while employed by the
1515 district. The notice must include:
1616 (1) an explanation of the district's policies
1717 regarding leave; and
1818 (2) a description of:
1919 (A) the personal leave the employee is entitled
2020 to as provided by Section 22.003;
2121 (B) the leave allowed for jury service as
2222 provided by Section 22.006; and
2323 (C) the leave allowed for complying with a
2424 subpoena as provided by Section 52.051(a), Labor Code.
2525 (b) If the employee is an educator certified under Chapter
2626 21, the notice must also include a description of leave allowed for:
2727 (1) observance of a religious holiday as provided by
2828 Section 21.406;
2929 (2) a temporary disability as provided by Section
3030 21.409; and
3131 (3) training and developmental purposes as provided by
3232 Section 21.452.
3333 (c) The notice required by this section must be given to a
3434 school district employee not later than the 10th day after the date
3535 the employee is hired by the district.
3636 SECTION 2. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2009.
