| 7 | 7 | | relating to notice of the leave policies of a school district to |
|---|
| 8 | 8 | | district employees. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 22, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 22.008 to read as follows: |
|---|
| 12 | 12 | | Sec. 22.008. NOTICE OF LEAVE POLICY. (a) A school district |
|---|
| 13 | 13 | | shall provide written notice to any district employee regarding the |
|---|
| 14 | 14 | | types of leave the employee is entitled to while employed by the |
|---|
| 15 | 15 | | district. The notice must include: |
|---|
| 16 | 16 | | (1) an explanation of the district's policies |
|---|
| 17 | 17 | | regarding leave; and |
|---|
| 18 | 18 | | (2) a description of: |
|---|
| 19 | 19 | | (A) the personal leave the employee is entitled |
|---|
| 20 | 20 | | to as provided by Section 22.003; |
|---|
| 21 | 21 | | (B) the leave allowed for jury service as |
|---|
| 22 | 22 | | provided by Section 22.006; and |
|---|
| 23 | 23 | | (C) the leave allowed for complying with a |
|---|
| 24 | 24 | | subpoena as provided by Section 52.051(a), Labor Code. |
|---|
| 25 | 25 | | (b) If the employee is an educator certified under Chapter |
|---|
| 26 | 26 | | 21, the notice must also include a description of leave allowed for: |
|---|
| 27 | 27 | | (1) observance of a religious holiday as provided by |
|---|
| 28 | 28 | | Section 21.406; |
|---|
| 29 | 29 | | (2) a temporary disability as provided by Section |
|---|
| 30 | 30 | | 21.409; and |
|---|
| 31 | 31 | | (3) training and developmental purposes as provided by |
|---|
| 32 | 32 | | Section 21.452. |
|---|
| 33 | 33 | | (c) The notice required by this section must be given to a |
|---|
| 34 | 34 | | school district employee not later than the 10th day after the date |
|---|
| 35 | 35 | | the employee is hired by the district. |
|---|
| 36 | 36 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 37 | 37 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 38 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 39 | 39 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 40 | 40 | | Act takes effect September 1, 2009. |
