7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
8 | 8 | | SECTION 1. Subchapter B, Chapter 88, Education Code, is |
---|
9 | 9 | | amended by adding Section 88.121 to read as follows: |
---|
10 | 10 | | Sec. 88.121. FUEL MITIGATION PILOT GRANT PROGRAM. (a) The |
---|
11 | 11 | | Texas Forest Service, with the advice of the advisory committee |
---|
12 | 12 | | appointed under Section 614.073, Government Code, may: |
---|
13 | 13 | | (1) establish and administer a pilot program under |
---|
14 | 14 | | this section to provide grants to fire departments to assist with |
---|
15 | 15 | | the costs of fuel mitigation; and |
---|
16 | 16 | | (2) adopt rules consistent with this section as |
---|
17 | 17 | | necessary to implement this section, including rules establishing: |
---|
18 | 18 | | (A) reasonable criteria and qualifications for |
---|
19 | 19 | | the distribution of grant money under the pilot program; and |
---|
20 | 20 | | (B) a procedure for reporting and processing |
---|
21 | 21 | | requests for grant money under the pilot program. |
---|
22 | 22 | | (b) The Texas Forest Service may solicit and accept gifts, |
---|
23 | 23 | | grants, and donations from any public or private source for |
---|
24 | 24 | | purposes of this section. |
---|
25 | 25 | | (c) If the Texas Forest Service establishes a pilot program |
---|
26 | 26 | | under this section, the director shall, not later than December 1, |
---|
27 | 27 | | 2010, submit a written report to the legislature on the |
---|
28 | 28 | | effectiveness of the pilot program in mitigating fuel hazards. |
---|
29 | 29 | | (d) Notwithstanding Section 614.075(b), Government Code, |
---|
30 | 30 | | money in the rural volunteer fire department insurance fund may |
---|
31 | 31 | | also be used for purposes of the pilot program under this section. |
---|
32 | 32 | | (e) This section expires September 1, 2011. |
---|
33 | 33 | | SECTION 2. This Act does not make an appropriation. A |
---|
34 | 34 | | provision in this Act that creates a new governmental program, |
---|
35 | 35 | | creates a new entitlement, or imposes a new duty on a governmental |
---|
36 | 36 | | entity is not mandatory during a fiscal period for which the |
---|
37 | 37 | | legislature has not made a specific appropriation to implement the |
---|
38 | 38 | | provision. |
---|
39 | 39 | | SECTION 3. This Act takes effect immediately if it receives |
---|
40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
---|
41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
---|
43 | 43 | | Act takes effect September 1, 2009. |
