 A BILL TO BE ENTITLED
 AN ACT
 relating to venue for the prosecution and punishment of certain
 offenses committed on the boundaries of two or more counties.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Article 13.04, Code of Criminal Procedure, is
 amended to read as follows:
 Art. 13.04. OFFENSES COMMITTED ON THE BOUNDARIES OF
 COUNTIES. (a) An offense committed on the boundaries of two or
 more counties, or within four hundred yards of those boundaries
 [thereof], may be prosecuted and punished in any one of those [such]
 counties.  This subsection does not apply to an offense committed
 under Subtitle E, Title 7, Transportation Code.
 (b) An [and any] offense committed on the premises of any
 airport operated jointly by two municipalities and situated in two
 counties may be prosecuted and punished in either county.
 SECTION 2. The change in law made by this Act applies only
 to venue for the trial of an offense committed on or after the
 effective date of this Act. Venue for the trial of an offense
 committed before the effective date of this Act is covered by the
 law in effect when the offense was committed, and the former law is
 continued in effect for that purpose. For purposes of this section,
 an offense was committed before the effective date of this Act if
 any element of the offense occurred before that date.
 SECTION 3. This Act takes effect September 1, 2009.
