| 7 | 7 | | relating to coverage of anorexia nervosa and bulimia nervosa as |
|---|
| 8 | 8 | | serious mental illnesses under certain group health benefit plans. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 1355.001(1), Insurance Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (1) "Serious mental illness" means the following |
|---|
| 13 | 13 | | psychiatric illnesses as defined by the American Psychiatric |
|---|
| 14 | 14 | | Association in the Diagnostic and Statistical Manual of Mental |
|---|
| 15 | 15 | | Disorders (DSM): |
|---|
| 16 | 16 | | (A) bipolar disorders (hypomanic, manic, |
|---|
| 17 | 17 | | depressive, and mixed); |
|---|
| 18 | 18 | | (B) depression in childhood and adolescence; |
|---|
| 19 | 19 | | (C) major depressive disorders (single episode |
|---|
| 20 | 20 | | or recurrent); |
|---|
| 21 | 21 | | (D) obsessive-compulsive disorders; |
|---|
| 22 | 22 | | (E) paranoid and other psychotic disorders; |
|---|
| 23 | 23 | | (F) schizo-affective disorders (bipolar or |
|---|
| 24 | 24 | | depressive); [and] |
|---|
| 25 | 25 | | (G) schizophrenia; |
|---|
| 26 | 26 | | (H) anorexia nervosa; and |
|---|
| 27 | 27 | | (I) bulimia nervosa. |
|---|
| 28 | 28 | | SECTION 2. (a) On or before September 1, 2012, the Sunset |
|---|
| 29 | 29 | | Advisory Commission shall conduct a study to determine: |
|---|
| 30 | 30 | | (1) to what extent the health benefit plan coverage |
|---|
| 31 | 31 | | required by the change in law made by this Act to Section |
|---|
| 32 | 32 | | 1355.001(1), Insurance Code, is being used by enrollees in health |
|---|
| 33 | 33 | | benefit plans to which Subchapter A, Chapter 1355, Insurance Code, |
|---|
| 34 | 34 | | applies; and |
|---|
| 35 | 35 | | (2) the impact of the required coverage on the cost of |
|---|
| 36 | 36 | | those health benefit plans. |
|---|
| 37 | 37 | | (b) The Sunset Advisory Commission shall report its |
|---|
| 38 | 38 | | findings under this section to the legislature on or before January |
|---|
| 39 | 39 | | 1, 2013. |
|---|
| 40 | 40 | | (c) The Texas Department of Insurance and any other state |
|---|
| 41 | 41 | | agency shall cooperate with the Sunset Advisory Commission as |
|---|
| 42 | 42 | | necessary to implement this section. |
|---|
| 43 | 43 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 44 | 44 | | to a group health benefit plan that is delivered, issued for |
|---|
| 45 | 45 | | delivery, or renewed on or after January 1, 2010. A group health |
|---|
| 46 | 46 | | benefit plan that is delivered, issued for delivery, or renewed |
|---|
| 47 | 47 | | before January 1, 2010, is governed by the law as it existed |
|---|
| 48 | 48 | | immediately before the effective date of this Act, and that law is |
|---|
| 49 | 49 | | continued in effect for that purpose. |
|---|
| 50 | 50 | | SECTION 4. This Act takes effect September 1, 2009. |
