66 AN ACT
77 relating to coverage of anorexia nervosa and bulimia nervosa as
88 serious mental illnesses under certain group health benefit plans.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1355.001(1), Insurance Code, is amended
1111 to read as follows:
1212 (1) "Serious mental illness" means the following
1313 psychiatric illnesses as defined by the American Psychiatric
1414 Association in the Diagnostic and Statistical Manual of Mental
1515 Disorders (DSM):
1616 (A) bipolar disorders (hypomanic, manic,
1717 depressive, and mixed);
1818 (B) depression in childhood and adolescence;
1919 (C) major depressive disorders (single episode
2020 or recurrent);
2121 (D) obsessive-compulsive disorders;
2222 (E) paranoid and other psychotic disorders;
2323 (F) schizo-affective disorders (bipolar or
2424 depressive); [and]
2525 (G) schizophrenia;
2626 (H) anorexia nervosa; and
2727 (I) bulimia nervosa.
2828 SECTION 2. (a) On or before September 1, 2012, the Sunset
2929 Advisory Commission shall conduct a study to determine:
3030 (1) to what extent the health benefit plan coverage
3131 required by the change in law made by this Act to Section
3232 1355.001(1), Insurance Code, is being used by enrollees in health
3333 benefit plans to which Subchapter A, Chapter 1355, Insurance Code,
3434 applies; and
3535 (2) the impact of the required coverage on the cost of
3636 those health benefit plans.
3737 (b) The Sunset Advisory Commission shall report its
3838 findings under this section to the legislature on or before January
3939 1, 2013.
4040 (c) The Texas Department of Insurance and any other state
4141 agency shall cooperate with the Sunset Advisory Commission as
4242 necessary to implement this section.
4343 SECTION 3. The change in law made by this Act applies only
4444 to a group health benefit plan that is delivered, issued for
4545 delivery, or renewed on or after January 1, 2010. A group health
4646 benefit plan that is delivered, issued for delivery, or renewed
4747 before January 1, 2010, is governed by the law as it existed
4848 immediately before the effective date of this Act, and that law is
4949 continued in effect for that purpose.
5050 SECTION 4. This Act takes effect September 1, 2009.
