55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the abolition of the death penalty.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. The following provisions are repealed:
1010 (1) Sections 8.07(c), 12.31, 12.42(c)(3), and 19.03,
1111 Penal Code; and
1212 (2) Articles 37.071, 37.0711, 37.072, 43.14, 43.141,
1313 43.15, 43.16, 43.17, 43.18, 43.19, 43.20, 43.21, 43.22, 43.23,
1414 43.24, and 43.25, Code of Criminal Procedure.
1515 SECTION 2. (a) The change in law made by this Act applies
1616 only to an offense committed on or after the effective date of this
1717 Act. For purposes of this section, an offense is committed before
1818 the effective date of this Act if any element of the offense occurs
1919 before that date.
2020 (b) An offense committed before the effective date of this
2121 Act is governed by the law in effect when the offense was committed,
2222 and the former law is continued in effect for that purpose.
2323 SECTION 3. This Act takes effect September 1, 2009.
