 A BILL TO BE ENTITLED
 AN ACT
 relating to the abolition of the death penalty.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. The following provisions are repealed:
 (1) Sections 8.07(c), 12.31, 12.42(c)(3), and 19.03,
 Penal Code; and
 (2) Articles 37.071, 37.0711, 37.072, 43.14, 43.141,
 43.15, 43.16, 43.17, 43.18, 43.19, 43.20, 43.21, 43.22, 43.23,
 43.24, and 43.25, Code of Criminal Procedure.
 SECTION 2. (a) The change in law made by this Act applies
 only to an offense committed on or after the effective date of this
 Act. For purposes of this section, an offense is committed before
 the effective date of this Act if any element of the offense occurs
 before that date.
 (b) An offense committed before the effective date of this
 Act is governed by the law in effect when the offense was committed,
 and the former law is continued in effect for that purpose.
 SECTION 3. This Act takes effect September 1, 2009.
