| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter D, Chapter 12, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 12.137 to read as follows: |
|---|
| 12 | 12 | | Sec. 12.137. ACCOUNTABILITY OF CERTAIN OPEN-ENROLLMENT |
|---|
| 13 | 13 | | CHARTER SCHOOLS. (a) In this section, "student at high risk of |
|---|
| 14 | 14 | | dropping out of school" means a student who: |
|---|
| 15 | 15 | | (1) meets three or more of the criteria provided by |
|---|
| 16 | 16 | | Section 29.081(d); or |
|---|
| 17 | 17 | | (2) is at least 21 years of age but less than 26 years |
|---|
| 18 | 18 | | of age and otherwise meets at least one of the criteria provided by |
|---|
| 19 | 19 | | Section 29.081(d). |
|---|
| 20 | 20 | | (b) This section applies only to an open-enrollment charter |
|---|
| 21 | 21 | | school offering a high school curriculum in which 85 percent or more |
|---|
| 22 | 22 | | of the students enrolled in the school on the date specified by the |
|---|
| 23 | 23 | | agency are students at high risk of dropping out of school. |
|---|
| 24 | 24 | | (c) An open-enrollment charter school to which this section |
|---|
| 25 | 25 | | applies is not required to include the performance of a student at |
|---|
| 26 | 26 | | high risk of dropping out of school in any accountability report |
|---|
| 27 | 27 | | until the 180th day after the date the student first enrolls in the |
|---|
| 28 | 28 | | school. For purposes of this subsection, "accountability report" |
|---|
| 29 | 29 | | includes a report required under the academic excellence indicator |
|---|
| 30 | 30 | | system described by Section 39.051 or the performance-based |
|---|
| 31 | 31 | | monitoring analysis system. |
|---|
| 32 | 32 | | SECTION 2. This Act applies beginning with the 2009-2010 |
|---|
| 33 | 33 | | school year. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2009. |
