66 AN ACT
77 relating to accountability of certain open-enrollment charter
88 schools serving students at high risk of dropping out of school.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 12, Education Code, is
1111 amended by adding Section 12.137 to read as follows:
1212 Sec. 12.137. ACCOUNTABILITY OF CERTAIN OPEN-ENROLLMENT
1313 CHARTER SCHOOLS. (a) In this section, "student at high risk of
1414 dropping out of school" means a student who:
1515 (1) meets three or more of the criteria provided by
1616 Section 29.081(d); or
1717 (2) is at least 21 years of age but less than 26 years
1818 of age and otherwise meets at least one of the criteria provided by
1919 Section 29.081(d).
2020 (b) This section applies only to an open-enrollment charter
2121 school offering a high school curriculum in which 85 percent or more
2222 of the students enrolled in the school on the date specified by the
2323 agency are students at high risk of dropping out of school.
2424 (c) An open-enrollment charter school to which this section
2525 applies is not required to include the performance of a student at
2626 high risk of dropping out of school in any accountability report
2727 until the 180th day after the date the student first enrolls in the
2828 school. For purposes of this subsection, "accountability report"
2929 includes a report required under the academic excellence indicator
3030 system described by Section 39.051 or the performance-based
3131 monitoring analysis system.
3232 SECTION 2. This Act applies beginning with the 2009-2010
3333 school year.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2009.
