 A BILL TO BE ENTITLED
 AN ACT
 relating to accountability of certain open-enrollment charter
 schools serving students at high risk of dropping out of school.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Subchapter D, Chapter 12, Education Code, is
 amended by adding Section 12.137 to read as follows:
 Sec. 12.137.  ACCOUNTABILITY OF CERTAIN OPEN-ENROLLMENT
 CHARTER SCHOOLS. (a) In this section, "student at high risk of
 dropping out of school" means a student who:
 (1)  meets three or more of the criteria provided by
 Section 29.081(d); or
 (2)  is at least 21 years of age but less than 26 years
 of age and otherwise meets at least one of the criteria provided by
 Section 29.081(d).
 (b)  This section applies only to an open-enrollment charter
 school offering a high school curriculum in which 85 percent or more
 of the students enrolled in the school on the date specified by the
 agency are students at high risk of dropping out of school.
 (c)  An open-enrollment charter school to which this section
 applies is not required to include the performance of a student at
 high risk of dropping out of school in any accountability report
 until the 180th day after the date the student first enrolls in the
 school. For purposes of this subsection, "accountability report"
 includes a report required under the academic excellence indicator
 system described by Section 39.051 or the performance-based
 monitoring analysis system.
 SECTION 2. This Act applies beginning with the 2009-2010
 school year.
 SECTION 3. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
