77 relating to the compensation of an election judge or clerk.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 32.091(a) and (c), Election Code, are
1010 amended to read as follows:
1111 (a) Except as provided by Subsection (c), an election judge
1212 or clerk is entitled to compensation for services rendered at a
1313 precinct polling place at an hourly rate not to exceed the amount
1414 fixed by the appropriate authority, which amount must be at least
1515 1-1/2 times the federal minimum hourly wage. A judge or clerk may
1616 be compensated at that rate for services rendered under Section
1717 62.014(c).
1818 (c) For a primary or runoff primary election, the minimum
1919 hourly rate is the greater of the maximum rate provided by
2020 Subsection (a) or, if the election officer attended a training
2121 program as provided by Subchapter F, $11 [$7].
2222 SECTION 2. Subchapter E, Chapter 32, Election Code, is
2323 amended by adding Section 32.095 to read as follows:
2424 Sec. 32.095. DEADLINE FOR COMPENSATION. The authority
2525 fixing compensation under Section 32.093 shall provide for
2626 compensation to be paid to an election judge or clerk not later than
2727 72 hours after the time the compensation statement is submitted
2828 under Section 32.094.
2929 SECTION 3. Section 32.112, Election Code, is amended to
3030 read as follows:
3131 Sec. 32.112. EXPENSE OF TRAINING JUDGES. (a) The
3232 governing body of a political subdivision may appropriate funds to:
3333 (1) compensate its election judges, early voting
3434 clerk, and deputy early voting clerks in charge of early voting
3535 polling places for attending a training program required under
3636 Section 32.111, at an hourly rate at least 1-1/2 times the federal
3737 minimum hourly wage, not to exceed the maximum rate of compensation
3838 of an election judge for services rendered at a precinct polling
3939 place or, if applicable, for attending a training program under
4040 Section 32.114; and
4141 (2) pay the expenses of conducting the programs.
4242 (b) A political subdivision making an appropriation under
4343 this section shall provide for compensation to be paid to an
4444 election judge or clerk not later than 72 hours after the time the
4545 judge or clerk provides documentation acceptable to the political
4646 subdivision that the person is entitled to compensation under this
4747 section.
4848 SECTION 4. The changes in law made by this Act apply only to
4949 compensation for an election judge or clerk for services rendered
5050 or training attended on or after the effective date of this Act.
5151 SECTION 5. This Act takes effect September 1, 2009.
