7 | 7 | | relating to the compensation of an election judge or clerk. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Sections 32.091(a) and (c), Election Code, are |
---|
10 | 10 | | amended to read as follows: |
---|
11 | 11 | | (a) Except as provided by Subsection (c), an election judge |
---|
12 | 12 | | or clerk is entitled to compensation for services rendered at a |
---|
13 | 13 | | precinct polling place at an hourly rate not to exceed the amount |
---|
14 | 14 | | fixed by the appropriate authority, which amount must be at least |
---|
15 | 15 | | 1-1/2 times the federal minimum hourly wage. A judge or clerk may |
---|
16 | 16 | | be compensated at that rate for services rendered under Section |
---|
17 | 17 | | 62.014(c). |
---|
18 | 18 | | (c) For a primary or runoff primary election, the minimum |
---|
19 | 19 | | hourly rate is the greater of the maximum rate provided by |
---|
20 | 20 | | Subsection (a) or, if the election officer attended a training |
---|
21 | 21 | | program as provided by Subchapter F, $11 [$7]. |
---|
22 | 22 | | SECTION 2. Subchapter E, Chapter 32, Election Code, is |
---|
23 | 23 | | amended by adding Section 32.095 to read as follows: |
---|
24 | 24 | | Sec. 32.095. DEADLINE FOR COMPENSATION. The authority |
---|
25 | 25 | | fixing compensation under Section 32.093 shall provide for |
---|
26 | 26 | | compensation to be paid to an election judge or clerk not later than |
---|
27 | 27 | | 72 hours after the time the compensation statement is submitted |
---|
28 | 28 | | under Section 32.094. |
---|
29 | 29 | | SECTION 3. Section 32.112, Election Code, is amended to |
---|
30 | 30 | | read as follows: |
---|
31 | 31 | | Sec. 32.112. EXPENSE OF TRAINING JUDGES. (a) The |
---|
32 | 32 | | governing body of a political subdivision may appropriate funds to: |
---|
33 | 33 | | (1) compensate its election judges, early voting |
---|
34 | 34 | | clerk, and deputy early voting clerks in charge of early voting |
---|
35 | 35 | | polling places for attending a training program required under |
---|
36 | 36 | | Section 32.111, at an hourly rate at least 1-1/2 times the federal |
---|
37 | 37 | | minimum hourly wage, not to exceed the maximum rate of compensation |
---|
38 | 38 | | of an election judge for services rendered at a precinct polling |
---|
39 | 39 | | place or, if applicable, for attending a training program under |
---|
40 | 40 | | Section 32.114; and |
---|
41 | 41 | | (2) pay the expenses of conducting the programs. |
---|
42 | 42 | | (b) A political subdivision making an appropriation under |
---|
43 | 43 | | this section shall provide for compensation to be paid to an |
---|
44 | 44 | | election judge or clerk not later than 72 hours after the time the |
---|
45 | 45 | | judge or clerk provides documentation acceptable to the political |
---|
46 | 46 | | subdivision that the person is entitled to compensation under this |
---|
47 | 47 | | section. |
---|
48 | 48 | | SECTION 4. The changes in law made by this Act apply only to |
---|
49 | 49 | | compensation for an election judge or clerk for services rendered |
---|
50 | 50 | | or training attended on or after the effective date of this Act. |
---|
51 | 51 | | SECTION 5. This Act takes effect September 1, 2009. |
