55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study by the Texas Commission on Environmental
88 Quality of toxic air pollutants in this state.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. DEFINITION. In this Act, "commission" means the
1111 Texas Commission on Environmental Quality.
1212 SECTION 2. STUDY. (a) The commission shall conduct a study
1313 to identify the three toxic air contaminants with the highest
1414 emissions levels in this state. In conducting the study, the
1515 commission shall:
1616 (1) determine the main emission sources for each of
1717 the three toxic air contaminants; and
1818 (2) evaluate the effects of emissions for each of the
1919 toxic air contaminants on the public health.
2020 (b) The commission shall evaluate the data collected during
2121 the study and recommend strategies for reducing emissions levels
2222 for each of the toxic air contaminants identified by the study
2323 conducted under Subsection (a) of this section.
2424 SECTION 3. REPORT. Not later than December 1, 2010, the
2525 commission shall report the results and recommendations of the
2626 study conducted under this Act to the governor, the lieutenant
2727 governor, the speaker of the house of representatives, and the
2828 standing committees of the house of representatives and the senate
2929 with primary jurisdiction over environmental matters.
3030 SECTION 4. EXPIRATION. This Act expires January 1, 2011.
3131 SECTION 5. EFFECTIVE DATE. This Act takes effect
3232 immediately if it receives a vote of two-thirds of all the members
3333 elected to each house, as provided by Section 39, Article III, Texas
3434 Constitution. If this Act does not receive the vote necessary for
3535 immediate effect, this Act takes effect September 1, 2009.
