| 7 | 7 | | relating to a study by the Texas Commission on Environmental |
|---|
| 8 | 8 | | Quality of toxic air pollutants in this state. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. DEFINITION. In this Act, "commission" means the |
|---|
| 11 | 11 | | Texas Commission on Environmental Quality. |
|---|
| 12 | 12 | | SECTION 2. STUDY. (a) The commission shall conduct a study |
|---|
| 13 | 13 | | to identify the three toxic air contaminants with the highest |
|---|
| 14 | 14 | | emissions levels in this state. In conducting the study, the |
|---|
| 15 | 15 | | commission shall: |
|---|
| 16 | 16 | | (1) determine the main emission sources for each of |
|---|
| 17 | 17 | | the three toxic air contaminants; and |
|---|
| 18 | 18 | | (2) evaluate the effects of emissions for each of the |
|---|
| 19 | 19 | | toxic air contaminants on the public health. |
|---|
| 20 | 20 | | (b) The commission shall evaluate the data collected during |
|---|
| 21 | 21 | | the study and recommend strategies for reducing emissions levels |
|---|
| 22 | 22 | | for each of the toxic air contaminants identified by the study |
|---|
| 23 | 23 | | conducted under Subsection (a) of this section. |
|---|
| 24 | 24 | | SECTION 3. REPORT. Not later than December 1, 2010, the |
|---|
| 25 | 25 | | commission shall report the results and recommendations of the |
|---|
| 26 | 26 | | study conducted under this Act to the governor, the lieutenant |
|---|
| 27 | 27 | | governor, the speaker of the house of representatives, and the |
|---|
| 28 | 28 | | standing committees of the house of representatives and the senate |
|---|
| 29 | 29 | | with primary jurisdiction over environmental matters. |
|---|
| 30 | 30 | | SECTION 4. EXPIRATION. This Act expires January 1, 2011. |
|---|
| 31 | 31 | | SECTION 5. EFFECTIVE DATE. This Act takes effect |
|---|
| 32 | 32 | | immediately if it receives a vote of two-thirds of all the members |
|---|
| 33 | 33 | | elected to each house, as provided by Section 39, Article III, Texas |
|---|
| 34 | 34 | | Constitution. If this Act does not receive the vote necessary for |
|---|
| 35 | 35 | | immediate effect, this Act takes effect September 1, 2009. |
