 A BILL TO BE ENTITLED
 AN ACT
 relating to a study by the Texas Commission on Environmental
 Quality of toxic air pollutants in this state.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. DEFINITION. In this Act, "commission" means the
 Texas Commission on Environmental Quality.
 SECTION 2. STUDY. (a) The commission shall conduct a study
 to identify the three toxic air contaminants with the highest
 emissions levels in this state. In conducting the study, the
 commission shall:
 (1) determine the main emission sources for each of
 the three toxic air contaminants; and
 (2) evaluate the effects of emissions for each of the
 toxic air contaminants on the public health.
 (b) The commission shall evaluate the data collected during
 the study and recommend strategies for reducing emissions levels
 for each of the toxic air contaminants identified by the study
 conducted under Subsection (a) of this section.
 SECTION 3. REPORT. Not later than December 1, 2010, the
 commission shall report the results and recommendations of the
 study conducted under this Act to the governor, the lieutenant
 governor, the speaker of the house of representatives, and the
 standing committees of the house of representatives and the senate
 with primary jurisdiction over environmental matters.
 SECTION 4. EXPIRATION. This Act expires January 1, 2011.
 SECTION 5. EFFECTIVE DATE. This Act takes effect
 immediately if it receives a vote of two-thirds of all the members
 elected to each house, as provided by Section 39, Article III, Texas
 Constitution. If this Act does not receive the vote necessary for
 immediate effect, this Act takes effect September 1, 2009.
