77 relating to reports of certain information relating to foster homes
88 by the Department of Family and Protective Services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 42, Human Resources Code,
1111 is amended by adding Section 42.0481 to read as follows:
1212 Sec. 42.0481. REPORT REGARDING WAIVERS GRANTED TO LICENSED
1313 FACILITIES. Not later than December 1 of each year, the department
1414 shall report to the lieutenant governor, the speaker of the house of
1515 representatives, and the standing committee of each house of the
1616 legislature with primary jurisdiction over child-care facilities:
1717 (1) the number of licenses for foster homes and foster
1818 group homes issued by the department for which the department
1919 granted a non-safety-related waiver;
2020 (2) the specific licensing requirements for which the
2121 department issued a non-safety-related waiver;
2222 (3) the number of relative caregivers whose homes
2323 would qualify to become a licensed foster home or foster group home
2424 without a non-safety-related waiver; and
2525 (4) the number of relative caregivers whose homes
2626 would qualify to become a licensed foster home or foster group home
2727 if granted a non-safety-related waiver.
2828 SECTION 2. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2009.
