| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 42, Human Resources Code, |
|---|
| 11 | 11 | | is amended by adding Section 42.0481 to read as follows: |
|---|
| 12 | 12 | | Sec. 42.0481. REPORT REGARDING WAIVERS GRANTED TO LICENSED |
|---|
| 13 | 13 | | FACILITIES. Not later than December 1 of each year, the department |
|---|
| 14 | 14 | | shall report to the lieutenant governor, the speaker of the house of |
|---|
| 15 | 15 | | representatives, and the standing committee of each house of the |
|---|
| 16 | 16 | | legislature with primary jurisdiction over child-care facilities: |
|---|
| 17 | 17 | | (1) the number of licenses for foster homes and foster |
|---|
| 18 | 18 | | group homes issued by the department for which the department |
|---|
| 19 | 19 | | granted a non-safety-related waiver; |
|---|
| 20 | 20 | | (2) the specific licensing requirements for which the |
|---|
| 21 | 21 | | department issued a non-safety-related waiver; |
|---|
| 22 | 22 | | (3) the number of relative caregivers whose homes |
|---|
| 23 | 23 | | would qualify to become a licensed foster home or foster group home |
|---|
| 24 | 24 | | without a non-safety-related waiver; and |
|---|
| 25 | 25 | | (4) the number of relative caregivers whose homes |
|---|
| 26 | 26 | | would qualify to become a licensed foster home or foster group home |
|---|
| 27 | 27 | | if granted a non-safety-related waiver. |
|---|
| 28 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2009. |
