 A BILL TO BE ENTITLED
 AN ACT
 relating to reports of certain information relating to foster homes
 by the Department of Family and Protective Services.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Subchapter C, Chapter 42, Human Resources Code,
 is amended by adding Section 42.0481 to read as follows:
 Sec. 42.0481.  REPORT REGARDING WAIVERS GRANTED TO LICENSED
 FACILITIES. Not later than December 1 of each year, the department
 shall report to the lieutenant governor, the speaker of the house of
 representatives, and the standing committee of each house of the
 legislature with primary jurisdiction over child-care facilities:
 (1)  the number of licenses for foster homes and foster
 group homes issued by the department for which the department
 granted a non-safety-related waiver;
 (2)  the specific licensing requirements for which the
 department issued a non-safety-related waiver;
 (3)  the number of relative caregivers whose homes
 would qualify to become a licensed foster home or foster group home
 without a non-safety-related waiver; and
 (4)  the number of relative caregivers whose homes
 would qualify to become a licensed foster home or foster group home
 if granted a non-safety-related waiver.
 SECTION 2. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
