| 7 | 7 | | statement regarding the rights and responsibilities of those |

| 8 | 8 | | persons and the agency. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 42, Human Resources Code, |
|---|
| 11 | 11 | | is amended by adding Section 42.0452 to read as follows: |
|---|
| 12 | 12 | | Sec. 42.0452. FOSTER PARENT RIGHTS AND RESPONSIBILITIES |
|---|
| 13 | 13 | | STATEMENT. (a) The department shall develop a statement that lists |
|---|
| 14 | 14 | | the rights and responsibilities of a foster parent in a foster home |
|---|
| 15 | 15 | | or an agency foster home and of the department or a child-placing |
|---|
| 16 | 16 | | agency, as applicable. |
|---|
| 17 | 17 | | (b) The department shall provide a written copy of the |
|---|
| 18 | 18 | | statement developed under Subsection (a) to each foster parent in a |
|---|
| 19 | 19 | | foster home and to each child-placing agency licensed by the |
|---|
| 20 | 20 | | department. A child-placing agency shall provide a written copy of |
|---|
| 21 | 21 | | the statement developed under Subsection (a) to each foster parent |
|---|
| 22 | 22 | | in an agency foster home verified by the child-placing agency. |
|---|
| 23 | 23 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect September 1, 2009. |
