66 AN ACT
77 relating to medical assistance reimbursement for prescriptions
88 issued by certain health care providers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 32.024, Human Resources Code, is amended
1111 by adding Subsection (z-3) to read as follows:
1212 (z-3) Subject to Subsection (z), the department shall
1313 provide medical assistance reimbursement to a pharmacy or other
1414 health care provider for prescription drugs provided to a medical
1515 assistance recipient as authorized by a prescription issued to the
1616 recipient by a health care provider whose application for a medical
1717 assistance provider number is pending with the department. The
1818 executive commissioner of the Health and Human Services Commission
1919 may adopt rules as necessary under which the department will issue a
2020 temporary provider number to a health care provider on the
2121 provider's submission of an application for a permanent number.
2222 The temporary number may be used by the provider when issuing
2323 prescriptions subject to this subsection.
2424 SECTION 2. If before implementing any provision of this Act
2525 a state agency determines that a waiver or authorization from a
2626 federal agency is necessary for implementation of that provision,
2727 the agency affected by the provision shall request the waiver or
2828 authorization and may delay implementing that provision until the
2929 waiver or authorization is granted.
3030 SECTION 3. This Act takes effect September 1, 2009.
