| 7 | 7 | | relating to medical assistance reimbursement for prescriptions |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 32.024, Human Resources Code, is amended |
|---|
| 11 | 11 | | by adding Subsection (z-3) to read as follows: |
|---|
| 12 | 12 | | (z-3) Subject to Subsection (z), the department shall |
|---|
| 13 | 13 | | provide medical assistance reimbursement to a pharmacy or other |
|---|
| 14 | 14 | | health care provider for prescription drugs provided to a medical |
|---|
| 15 | 15 | | assistance recipient as authorized by a prescription issued to the |
|---|
| 16 | 16 | | recipient by a health care provider whose application for a medical |
|---|
| 17 | 17 | | assistance provider number is pending with the department. The |
|---|
| 18 | 18 | | executive commissioner of the Health and Human Services Commission |
|---|
| 19 | 19 | | may adopt rules as necessary under which the department will issue a |
|---|
| 20 | 20 | | temporary provider number to a health care provider on the |
|---|
| 21 | 21 | | provider's submission of an application for a permanent number. |
|---|
| 22 | 22 | | The temporary number may be used by the provider when issuing |
|---|
| 23 | 23 | | prescriptions subject to this subsection. |
|---|
| 24 | 24 | | SECTION 2. If before implementing any provision of this Act |
|---|
| 25 | 25 | | a state agency determines that a waiver or authorization from a |
|---|
| 26 | 26 | | federal agency is necessary for implementation of that provision, |
|---|
| 27 | 27 | | the agency affected by the provision shall request the waiver or |
|---|
| 28 | 28 | | authorization and may delay implementing that provision until the |
|---|
| 29 | 29 | | waiver or authorization is granted. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2009. |
