 A BILL TO BE ENTITLED
 AN ACT
 relating to medical assistance reimbursement for prescriptions
 issued by certain health care providers.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 32.024, Human Resources Code, is amended
 by adding Subsection (z-3) to read as follows:
 (z-3)  Subject to Subsection (z), the department shall
 provide medical assistance reimbursement to a pharmacy or other
 health care provider for prescription drugs provided to a medical
 assistance recipient as authorized by a prescription issued to the
 recipient by a health care provider whose application for a medical
 assistance provider number is pending with the department. The
 executive commissioner of the Health and Human Services Commission
 may adopt rules as necessary under which the department will issue a
 temporary provider number to a health care provider on the
 provider's submission of an application for a permanent number.
 The temporary number may be used by the provider when issuing
 prescriptions subject to this subsection.
 SECTION 2. If before implementing any provision of this Act
 a state agency determines that a waiver or authorization from a
 federal agency is necessary for implementation of that provision,
 the agency affected by the provision shall request the waiver or
 authorization and may delay implementing that provision until the
 waiver or authorization is granted.
 SECTION 3. This Act takes effect September 1, 2009.
