| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 825.516(a), Government Code, is amended | |
| 11 | 11 | to read as follows: | |
| 12 | 12 | (a) A retiree who is receiving an annuity from the | |
| 13 | 13 | retirement system may request the system to withhold from the | |
| 14 | 14 | retiree's monthly annuity payment membership dues for a nonprofit | |
| 15 | 15 | association of retired school employees in this state, if the | |
| 16 | 16 | association: | |
| 17 | 17 | (1) is statewide and; | |
| 18 | 18 | (2) its membership includes: | |
| 19 | 19 | (A) at least five percent of all retirees of the | |
| 20 | 20 | retirement system; | |
| 21 | 21 | (B) at least 50,000 members and retirees of the | |
| 22 | 22 | retirement system; or | |
| 23 | 23 | (C) is a state employee organization qualified | |
| 24 | 24 | for Employees Retirement System of Texas annuity deduction under | |
| 25 | 25 | Sec. 814.009. | |
| 26 | 26 | The request for withholding must be on a form provided by the | |
| 27 | 27 | retirement system. | |
| 28 | 28 | SECTION 2. This Act takes effect immediately if it receives | |
| 29 | 29 | a vote of two-thirds of all the members elected to each house, as | |
| 30 | 30 | provided by Section 39, Article III, Texas Constitution. If this | |
| 31 | 31 | Act does not receive the vote necessary for immediate effect, this | |
| 32 | 32 | Act takes effect September 1, 2009. |
