A BILL TO BE ENTITLED
AN ACT
relating to the Teacher Retirement System of Texas withholding
certain nonprofit association dues from the annuity payments of
certain members.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 825.516(a), Government Code, is amended
to read as follows:
(a) A retiree who is receiving an annuity from the
retirement system may request the system to withhold from the
retiree's monthly annuity payment membership dues for a nonprofit
association of retired school employees in this state, if the
association:
(1) is statewide and;
(2) its membership includes:
(A) at least five percent of all retirees of the
retirement system;
(B) at least 50,000 members and retirees of the
retirement system; or
(C) is a state employee organization qualified
for Employees Retirement System of Texas annuity deduction under
Sec. 814.009.
The request for withholding must be on a form provided by the
retirement system.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2009.
