99 relating to the creation and operation of a council to increase
1010 state efforts to offer service-enriched housing through increased
1111 coordination of housing and health services.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 2306, Government Code, is amended by
1414 adding Subchapter NN to read as follows:
1515 SUBCHAPTER NN. HOUSING AND HEALTH SERVICES COORDINATION COUNCIL
1616 Sec. 2306.1091. DEFINITIONS. In this subchapter:
1717 (1) "Council" means the housing and health services
1818 coordination council.
1919 (2) "Service-enriched housing" means a living
2020 arrangement that provides health services or social services, or
2121 both, to older adults in an accessible, supportive environment.
2222 Sec. 2306.1092. COMPOSITION. (a) The department shall
2323 establish a housing and health services coordination council.
2424 (b) The council is composed of 15 members consisting of:
2525 (1) the director;
2626 (2) one representative from each of the following
2727 agencies, appointed by the head of that agency:
2828 (A) the Office of Rural Community Affairs;
2929 (B) the Texas State Affordable Housing
3030 Corporation;
3131 (C) the Health and Human Services Commission;
3232 (D) the Department of Assistive and
3333 Rehabilitative Services; and
3434 (E) the Department of Aging and Disability
3535 Services;
3636 (3) one representative from the Department of
3737 Agriculture who is:
3838 (A) knowledgeable about the Texans Feeding
3939 Texans and Retire in Texas programs or similar programs; and
4040 (B) appointed by the head of that agency;
4141 (4) one member who is:
4242 (A) a member of an advisory committee to the
4343 Department of Aging and Disability Services that promotes
4444 independence for older adults; and
4545 (B) appointed by the governor; and
4646 (5) one representative from each of the following
4747 interest groups, appointed by the governor:
4848 (A) financial institutions;
4949 (B) multifamily housing developers;
5050 (C) health services entities;
5151 (D) nonprofit organizations;
5252 (E) consumers of service-enriched housing;
5353 (F) advocates for minority issues; and
5454 (G) rural communities.
5555 (c) A member of the council appointed under Subsection
5656 (b)(2) must have, subject to the approval of the head of the agency,
5757 authority to make decisions for and commit resources of the agency
5858 that the member represents and must have:
5959 (1) administrative responsibility for agency programs
6060 for older adults;
6161 (2) knowledge or experience regarding the
6262 implementation of projects that integrate housing and health
6363 services; or
6464 (3) knowledge or experience regarding services used by
6565 older adults.
6666 (d) The director serves as the presiding officer of the
6767 council.
6868 Sec. 2306.1093. TERMS. (a) A member of the council who
6969 represents a state agency serves at the pleasure of the head of that
7070 agency.
7171 (b) Members of the council who are appointed by the governor
7272 serve staggered six-year terms, with the terms of two or three
7373 members expiring on September 1 of each odd-numbered year.
7474 Sec. 2306.1094. OPERATION OF COUNCIL. (a) The council
7575 shall meet at least quarterly.
7676 (b) The department shall provide clerical and advisory
7777 support staff to the council.
7878 (c) Except as provided by Section 2306.1095, Chapter 2110
7979 does not apply to the size, composition, or duration of the council.
8080 Sec. 2306.1095. COMPENSATION AND REIMBURSEMENT. (a) A
8181 member of the council who is appointed by the governor may not
8282 receive compensation for service on the council. The member may
8383 receive reimbursement from the department for actual and necessary
8484 expenses incurred in performing council functions as provided by
8585 Section 2110.004.
8686 (b) A member of the council who is not appointed by the
8787 governor may not receive compensation for service on the council or
8888 reimbursement for expenses incurred in performing council
8989 functions.
9090 Sec. 2306.1096. DUTIES; BIENNIAL REPORT. (a) The council
9191 shall:
9292 (1) develop and implement policies to coordinate and
9393 increase state efforts to offer service-enriched housing;
9494 (2) identify barriers preventing or slowing
9595 service-enriched housing efforts, including barriers attributable
9696 to the following factors:
9797 (A) regulatory requirements and limitations;
9898 (B) administrative limitations;
9999 (C) limitations on funding; and
100100 (D) ineffective or limited coordination;
101101 (3) develop a system to cross-educate selected staff
102102 in state housing and health services agencies to increase the
103103 number of staff with expertise in both areas and to coordinate
104104 relevant staff activities of those agencies;
105105 (4) identify opportunities for state housing and
106106 health services agencies to provide technical assistance and
107107 training to local housing and health services entities about:
108108 (A) the cross-education of staff;
109109 (B) coordination among those entities; and
110110 (C) opportunities to increase local efforts to
111111 create service-enriched housing; and
112112 (5) develop suggested performance measures to track
113113 progress in:
114114 (A) the reduction or elimination of barriers in
115115 creating service-enriched housing;
116116 (B) increasing the coordination between state
117117 housing and health services agencies;
118118 (C) increasing the number of state housing and
119119 health services staff who are cross-educated or who have expertise
120120 in both housing and health services programs; and
121121 (D) the provision of technical assistance to
122122 local communities by state housing and health services staff to
123123 increase the number of service-enriched housing projects.
124124 (b) The council shall develop a biennial plan to implement
125125 the goals described by Subsection (a).
126126 (c) Not later than August 1 of each even-numbered year, the
127127 council shall deliver a report of the council's findings and
128128 recommendations to the governor and the Legislative Budget Board.
129129 Sec. 2306.1097. GIFTS AND GRANTS. The council may solicit
130130 and accept gifts, grants, and donations for the purposes of this
131131 subchapter.
132132 Sec. 2306.1098. DUTIES OF EMPLOYEES PROVIDING ADVISORY
133133 SUPPORT TO COUNCIL. Department employees assigned to provide
134134 advisory support to the council shall:
135135 (1) identify sources of funding from this state and
136136 the federal government that may be used to provide integrated
137137 housing and health services;
138138 (2) determine the requirements and application
139139 guidelines to obtain those funds;
140140 (3) provide training materials that assist the
141141 development and financing of a service-enriched housing project;
142142 (4) provide information regarding:
143143 (A) effective methods to collaborate with
144144 governmental entities, service providers, and financial
145145 institutions; and
146146 (B) the use of layered financing to provide and
147147 finance service-enriched housing;
148148 (5) create a financial feasibility model that assists
149149 in making a preliminary determination of the financial viability of
150150 proposed service-enriched housing projects, including models that
151151 allow a person to analyze multiuse projects that facilitate the
152152 development of projects that will:
153153 (A) address the needs of communities with
154154 different populations; and
155155 (B) achieve economies of scale required to make
156156 the projects financially viable;
157157 (6) facilitate communication between state agencies,
158158 sources of funding, service providers, and other entities to reduce
159159 or eliminate barriers to service-enriched housing projects;
160160 (7) provide training about local, state, and federal
161161 funding sources and the requirements for those sources;
162162 (8) develop a database to identify, describe, monitor,
163163 and track the progress of all service-enriched housing projects
164164 developed in this state with state or federal financial assistance;
165165 (9) conduct a biennial evaluation and include in the
166166 council's report to the governor and the Legislative Budget Board
167167 under Section 2306.1096 information regarding:
168168 (A) the capacity of statewide long-term care
169169 providers; and
170170 (B) interest by housing developers in investing
171171 in service-enriched housing;
172172 (10) to increase the consistency in housing
173173 regulations, recommend changes to home and community-based
174174 Medicaid waivers that are up for renewal;
175175 (11) research best practices with respect to
176176 service-enriched housing projects subsidized by other states; and
177177 (12) create and maintain a clearinghouse of
178178 information that contains tools and resources for entities seeking
179179 to create or finance service-enriched housing projects.
180180 SECTION 2. (a) As soon as possible after the effective date
181181 of this Act, the governor and the heads of the applicable state
182182 agencies shall appoint members to the housing and health services
183183 coordination council in accordance with Subchapter NN, Chapter
184184 2306, Government Code, as added by this Act.
185185 (b) In making initial appointments to the housing and health
186186 services coordination council, the governor shall appoint two
187187 members to serve a term expiring September 1, 2011, three members to
188188 serve a term expiring September 1, 2013, and three members to serve
189189 a term expiring September 1, 2015.
190190 SECTION 3. Not later than September 1, 2010, the housing and
191191 health services coordination council shall submit the first report
192192 of the council's findings and recommendations as required by
193193 Subchapter NN, Chapter 2306, Government Code, as added by this Act.
194194 SECTION 4. This Act takes effect September 1, 2009.
