LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION April 3, 2009 TO: Honorable Burt R. Solomons, Chair, House Committee on State Affairs FROM: John S. O'Brien, Director, Legislative Budget Board IN RE:HB3249 by Bohac (Relating to the display of month-to-month prices on www.powertochoose.org.), As Introduced No significant fiscal implication to the State is anticipated. The bill would require the Public Utility Commission (PUC) to adopt rules requiring all retail electric providers (REPs) to submit to the commission information regarding the REP's price for month-to-month service, including introductory or promotional offers and whether the REP offers month-to-month service other than at the end of a fixed price contract. The bill would require the PUC to display this information on its power-to-choose website. The bill would not require the PUC to warrant that the information regarding REP's month-to-month prices and offers are a complete or accurate list of all offers in the marketplace. The PUC indicates that any costs associated with the bill could be absorbed within the agency's existing resources. Local Government Impact No fiscal implication to units of local government is anticipated.
