A BILL TO BE ENTITLED
AN ACT
relating to the display of month-to-month prices on
www.powertochoose.org.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter C, Chapter 39, Utilities Code, is
amended by adding Section 39.1027 to read as follows:
Sec. 39.1027. INFORMATION REQUIRED TO BE DISPLAYED ON
INTERNET. (a) The commission by rule shall require a retail
electric provider to submit information to the commission
regarding:
(1) the retail electric provider's price for
month-to-month service, including introductory or promotional
offers; and
(2) whether the retail electric provider offers
month-to-month service other than at the expiration of a fixed
price contract.
(b) For each retail electric provider, the commission shall
display on the Internet website found at
http://www.powertochoose.org:
(1) the retail electric provider's price for
month-to-month service, including introductory or promotional
offers, as provided to the commission by the retail electric
provider; and
(2) whether the retail electric provider offers
month-to-month service other than at the expiration of a fixed
price contract, as indicated by the retail electric provider.
(c) This section does not require the commission to warrant
that the information displayed at http://www.powertochoose.org
constitutes a complete or accurate list of all retail electric
provider offers in the marketplace.
SECTION 2. This Act takes effect September 1, 2009.
