| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 39, Utilities Code, is |

| 11 | 11 | | amended by adding Section 39.1027 to read as follows: |
|---|
| 12 | 12 | | Sec. 39.1027. INFORMATION REQUIRED TO BE DISPLAYED ON |
|---|
| 13 | 13 | | INTERNET. (a) The commission by rule shall require a retail |
|---|
| 14 | 14 | | electric provider to submit information to the commission |
|---|
| 15 | 15 | | regarding: |
|---|
| 16 | 16 | | (1) the retail electric provider's price for |
|---|
| 17 | 17 | | month-to-month service, including introductory or promotional |
|---|
| 18 | 18 | | offers; and |
|---|
| 19 | 19 | | (2) whether the retail electric provider offers |
|---|
| 20 | 20 | | month-to-month service other than at the expiration of a fixed |
|---|
| 21 | 21 | | price contract. |
|---|
| 22 | 22 | | (b) For each retail electric provider, the commission shall |
|---|
| 23 | 23 | | display on the Internet website found at |
|---|
| 24 | 24 | | http://www.powertochoose.org: |
|---|
| 25 | 25 | | (1) the retail electric provider's price for |
|---|
| 26 | 26 | | month-to-month service, including introductory or promotional |
|---|
| 27 | 27 | | offers, as provided to the commission by the retail electric |
|---|
| 28 | 28 | | provider; and |
|---|
| 29 | 29 | | (2) whether the retail electric provider offers |
|---|
| 30 | 30 | | month-to-month service other than at the expiration of a fixed |
|---|
| 31 | 31 | | price contract, as indicated by the retail electric provider. |
|---|
| 32 | 32 | | (c) This section does not require the commission to warrant |
|---|
| 33 | 33 | | that the information displayed at http://www.powertochoose.org |
|---|
| 34 | 34 | | constitutes a complete or accurate list of all retail electric |
|---|
| 35 | 35 | | provider offers in the marketplace. |
|---|
| 36 | 36 | | SECTION 2. This Act takes effect September 1, 2009. |
