| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 284, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 284.014 to read as follows: |
|---|
| 12 | 12 | | Sec. 284.014. GENERAL RULEMAKING AUTHORITY. The |
|---|
| 13 | 13 | | commissioners court of a county to which this chapter applies shall |
|---|
| 14 | 14 | | adopt rules governing the implementation of this chapter, including |
|---|
| 15 | 15 | | rules relating to: |
|---|
| 16 | 16 | | (1) agreements with private entities for the |
|---|
| 17 | 17 | | financing, design, construction, or operation of a project; |
|---|
| 18 | 18 | | (2) the operation of a project, including rules |
|---|
| 19 | 19 | | regarding the amount of tolls charged, the method of collection of |
|---|
| 20 | 20 | | tolls, and the imposition of fines and administrative costs; |
|---|
| 21 | 21 | | (3) agreements with other public entities related to |
|---|
| 22 | 22 | | the financing, design, construction, or operation of a project; |
|---|
| 23 | 23 | | (4) acquisition of property for a project; and |
|---|
| 24 | 24 | | (5) the issuance of bonds for transportation projects. |

| 25 | 25 | | SECTION 2. This Act takes effect September 1, 2009. |
