A BILL TO BE ENTITLED
AN ACT
relating to construction, acquisition, improvement, operation, and
maintenance of toll projects by certain counties.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 284, Transportation Code,
is amended by adding Section 284.014 to read as follows:
Sec. 284.014. GENERAL RULEMAKING AUTHORITY. The
commissioners court of a county to which this chapter applies shall
adopt rules governing the implementation of this chapter, including
rules relating to:
(1) agreements with private entities for the
financing, design, construction, or operation of a project;
(2) the operation of a project, including rules
regarding the amount of tolls charged, the method of collection of
tolls, and the imposition of fines and administrative costs;
(3) agreements with other public entities related to
the financing, design, construction, or operation of a project;
(4) acquisition of property for a project; and
(5) the issuance of bonds for transportation projects.
SECTION 2. This Act takes effect September 1, 2009.
