| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter B, Chapter 91, Natural Resources | |
| 11 | 11 | Code, is amended by adding Section 91.019 to read as follows: | |
| 12 | 12 | Sec. 91.019. RESTRICTION ON LOCATION OF CERTAIN OIL AND GAS | |
| 13 | 13 | WELLS. A person may not drill a well for oil or gas at a location | |
| 14 | 14 | that is: | |
| 15 | 15 | (1) in an unincorporated area of a county; and | |
| 16 | 16 | (2) less than 500 feet from an established residence. | |
| 17 | 17 | SECTION 2. The change in law made by this Act applies only | |
| 18 | 18 | to a well for which the Railroad Commission of Texas issues a | |
| 19 | 19 | drilling permit on or after the effective date of this Act. A well | |
| 20 | 20 | for which the Railroad Commission of Texas issues a drilling permit | |
| 21 | 21 | before the effective date of this Act is subject to the law in | |
| 22 | 22 | effect on the date the permit is issued, and that law is continued | |
| 23 | 23 | in effect for that purpose. | |
| 24 | 24 | SECTION 3. This Act takes effect September 1, 2009. |
