 A BILL TO BE ENTITLED
 AN ACT
 relating to a restriction on the location of a well drilled for oil
 or gas.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Subchapter B, Chapter 91, Natural Resources
 Code, is amended by adding Section 91.019 to read as follows:
 Sec. 91.019.  RESTRICTION ON LOCATION OF CERTAIN OIL AND GAS
 WELLS. A person may not drill a well for oil or gas at a location
 that is:
 (1) in an unincorporated area of a county; and
 (2) less than 500 feet from an established residence.
 SECTION 2. The change in law made by this Act applies only
 to a well for which the Railroad Commission of Texas issues a
 drilling permit on or after the effective date of this Act. A well
 for which the Railroad Commission of Texas issues a drilling permit
 before the effective date of this Act is subject to the law in
 effect on the date the permit is issued, and that law is continued
 in effect for that purpose.
 SECTION 3. This Act takes effect September 1, 2009.
