8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Sections 1013.052 and 1013.062, Special District |
---|
10 | 10 | | Local Laws Code, are amended to read as follows: |
---|
11 | 11 | | Sec. 1013.052. NOTICE OF ELECTION. Notice [Not earlier |
---|
12 | 12 | | than the 30th day or later than the 10th day before the date] of an |
---|
13 | 13 | | election of directors [, notice of the election] shall be published |
---|
14 | 14 | | [one time] in a newspaper of general circulation in Castro County in |
---|
15 | 15 | | accordance with Section 4.003, Election Code. |
---|
16 | 16 | | Sec. 1013.062. RECRUITMENT OF MEDICAL STAFF AND |
---|
17 | 17 | | EMPLOYEES. (a) The board may spend district money, enter into |
---|
18 | 18 | | agreements, and take other necessary action to recruit physicians |
---|
19 | 19 | | and other persons to serve as medical staff members or district |
---|
20 | 20 | | employees, including: |
---|
21 | 21 | | (1) advertising and marketing; |
---|
22 | 22 | | (2) paying travel, recruitment, and relocation |
---|
23 | 23 | | expenses; |
---|
24 | 24 | | (3) providing a loan or scholarship to a physician or a |
---|
25 | 25 | | person who: |
---|
26 | 26 | | (A) is currently enrolled in health care |
---|
27 | 27 | | education courses at an institution of higher education; and |
---|
28 | 28 | | (B) contractually agrees to become a district |
---|
29 | 29 | | employee or medical staff member; and |
---|
30 | 30 | | (4) providing on a rent-free basis or subsidizing the |
---|
31 | 31 | | cost of office space or other facilities for a health care |
---|
32 | 32 | | professional, including a physician. |
---|
33 | 33 | | (b) The board may employ physicians or other health care |
---|
34 | 34 | | providers as the board considers necessary for the efficient |
---|
35 | 35 | | operation of the district. |
---|
36 | 36 | | (c) This section may not be construed as authorizing the |
---|
37 | 37 | | board to supervise or control the practice of medicine, as |
---|
38 | 38 | | prohibited by Subtitle B, Title 3, Occupations Code. |
---|
39 | 39 | | SECTION 2. Subchapter E, Chapter 1013, Special District |
---|
40 | 40 | | Local Laws Code, is amended by adding Sections 1013.209 and |
---|
41 | 41 | | 1013.210 to read as follows: |
---|
42 | 42 | | Sec. 1013.209. ADDITIONAL MEANS OF SECURING REPAYMENT OF |
---|
43 | 43 | | BONDS. In addition to the authority to issue general obligation |
---|
44 | 44 | | bonds and revenue bonds under this subchapter, the board may |
---|
45 | 45 | | provide for the security and payment of district bonds from a pledge |
---|
46 | 46 | | of a combination of ad valorem taxes as authorized by Section |
---|
47 | 47 | | 1013.202 and revenue and other sources authorized by Section |
---|
48 | 48 | | 1013.206. |
---|
49 | 49 | | Sec. 1013.210. USE OF BOND PROCEEDS. The district may use |
---|
50 | 50 | | the proceeds of bonds issued under this subchapter to pay: |
---|
51 | 51 | | (1) any expense the board determines is reasonable and |
---|
52 | 52 | | necessary to issue, sell, and deliver the bonds; |
---|
53 | 53 | | (2) interest payments on the bonds during a period of |
---|
54 | 54 | | acquisition or construction of a project or facility to be provided |
---|
55 | 55 | | through the bonds, not to exceed five years; |
---|
56 | 56 | | (3) costs related to the operation and maintenance of |
---|
57 | 57 | | a project or facility to be provided through the bonds: |
---|
58 | 58 | | (A) during an estimated period of acquisition or |
---|
59 | 59 | | construction, not to exceed five years; and |
---|
60 | 60 | | (B) for one year after the project or facility is |
---|
61 | 61 | | acquired or constructed; |
---|
62 | 62 | | (4) costs related to the financing of the bond funds, |
---|
63 | 63 | | including debt service reserve and contingency funds; |
---|
64 | 64 | | (5) costs related to the bond issuance; |
---|
65 | 65 | | (6) costs related to the acquisition of land or |
---|
66 | 66 | | interests in land for a project or facility to be provided through |
---|
67 | 67 | | the bonds; and |
---|
68 | 68 | | (7) costs of construction of a project or facility to |
---|
69 | 69 | | be provided through the bonds, including the payment of related |
---|
70 | 70 | | professional services and expenses. |
---|
71 | 71 | | SECTION 3. This Act takes effect immediately if it receives |
---|
72 | 72 | | a vote of two-thirds of all the members elected to each house, as |
---|
73 | 73 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
74 | 74 | | Act does not receive the vote necessary for immediate effect, this |
---|
75 | 75 | | Act takes effect September 1, 2009. |
