99 AN ACT
1010 relating to the disclosure of criminal history record information
1111 regarding public school employees.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 411.084, Government Code, is amended by
1414 amending Subsection (a) and adding Subsections (a-1) and (c) to
1515 read as follows:
1616 (a) Criminal history record information obtained from the
1717 department under this subchapter, including any identification
1818 information that could reveal the identity of a person about whom
1919 criminal history record information is requested and information
2020 that directly or indirectly indicates or implies involvement of a
2121 person in the criminal justice system:
2222 (1) is for the exclusive use of the authorized
2323 recipient of the information; and
2424 (2) may be disclosed or used by the recipient only if,
2525 and only to the extent that, disclosure or use is authorized or
2626 directed by:
2727 (A) this subchapter;
2828 (B) another statute;
2929 (C) a rule adopted under a statute; or
3030 (D) an order of a court of competent
3131 jurisdiction.
3232 (a-1) The term criminal history record information under
3333 Subsection (a) does not refer to any specific document produced to
3434 comply with this subchapter but to the information contained,
3535 wholly or partly, in a document's original form or any subsequent
3636 form or use.
3737 (c) An agency or individual may not confirm the existence or
3838 nonexistence of criminal history record information to any person
3939 that is not eligible to receive the information.
4040 SECTION 2. Sections 411.090(b) and (c), Government Code,
4141 are amended to read as follows:
4242 (b) Criminal history record information obtained by the
4343 board in the original form or any subsequent form [under Subsection
4444 (a)]:
4545 (1) may be used only for a [any] purpose related to the
4646 issuance, denial, suspension, or cancellation of a certificate
4747 issued by the board;
4848 (2) may not be released to any person except:
4949 (A) the person who is the subject of the
5050 information;
5151 (B) the Texas Education Agency;
5252 (C) a local or regional educational entity as
5353 provided by Section 411.097; or
5454 (D) by [on] court order [or with the consent of
5555 the applicant for a certificate]; [and]
5656 (3) is not subject to disclosure as provided by
5757 Chapter 552; and
5858 (4) shall be destroyed by the board after the
5959 information is used for the authorized purposes.
6060 (c) The department shall notify the State Board for Educator
6161 Certification of the arrest of any educator, as defined by Section
6262 5.001, Education Code, who has fingerprints on file with the
6363 department. Any record of the notification and any information
6464 contained in the notification is not subject to disclosure as
6565 provided by Chapter 552.
6666 SECTION 3. Section 411.0901, Government Code, is amended to
6767 read as follows:
6868 Sec. 411.0901. ACCESS TO CRIMINAL HISTORY RECORD
6969 INFORMATION: TEXAS EDUCATION AGENCY. (a) The Texas Education
7070 Agency is entitled to obtain criminal history record information
7171 maintained by the department about a person who:
7272 (1) is employed or is an applicant for employment by a
7373 school district or open-enrollment charter school;
7474 (2) is employed or is an applicant for employment by a
7575 shared services arrangement, if the employee's or applicant's
7676 duties are or will be performed on school property or at another
7777 location where students are regularly present; or
7878 (3) is employed or is an applicant for employment by an
7979 entity that contracts with a school district, open-enrollment
8080 charter school, or shared services arrangement if:
8181 (A) the employee or applicant has or will have
8282 continuing duties relating to the contracted services; and
8383 (B) the employee or applicant has or will have
8484 direct contact with students.
8585 (b) Criminal history record information obtained by the
8686 agency in the original form or any subsequent form:
8787 (1) may be used only for a purpose authorized by the
8888 Education Code;
8989 (2) may not be released to any person except:
9090 (A) the person who is the subject of the
9191 information;
9292 (B) the State Board for Educator Certification;
9393 (C) a local or regional educational entity as
9494 provided by Section 411.097; or
9595 (D) by court order;
9696 (3) is not subject to disclosure as provided by
9797 Chapter 552; and
9898 (4) shall be destroyed by the agency after the
9999 information is used for the authorized purposes.
100100 SECTION 4. Section 411.097, Government Code, is amended by
101101 amending Subsection (d) and adding Subsection (f) to read as
102102 follows:
103103 (d) Criminal history record information obtained by a
104104 school district, charter school, private school, service center,
105105 commercial transportation company, or shared services arrangement
106106 in the original form or any subsequent form:
107107 (1) [under Subsection (a), (b), or (c)] may not be
108108 released [or disclosed] to any person except:
109109 (A) [, other than] the individual who is the
110110 subject of the information;
111111 (B) [,] the Texas Education Agency;
112112 (C) [,] the State Board for Educator
113113 Certification;
114114 (D) [, or] the chief personnel officer of the
115115 transportation company, if the information is obtained under
116116 Subsection (a)(2); or
117117 (E) by court order;
118118 (2) is not subject to disclosure as provided by
119119 Chapter 552; and
120120 (3) shall be destroyed by the school district, charter
121121 school, private school, service center, commercial transportation
122122 company, or shared services arrangement on the earlier of:
123123 (A) the first anniversary of the date the
124124 information was originally obtained; or
125125 (B) the date the information is used for the
126126 authorized purpose.
127127 (f) An employee of a school district, charter school,
128128 private school, regional education service center, commercial
129129 transportation company, or education shared services arrangement
130130 or an entity that contracts to provide services to a school
131131 district, charter school, or shared services arrangement may
132132 request from the employer a copy of any criminal history record
133133 information relating to that employee that the employer has
134134 obtained as provided by Subchapter C, Chapter 22, Education Code.
135135 The employer may charge a fee to an employee requesting a copy of
136136 the information in an amount not to exceed the actual cost of
137137 copying the requested criminal history record information.
138138 SECTION 5. Subchapter C, Chapter 22, Education Code, is
139139 amended by adding Section 22.08391 to read as follows:
140140 Sec. 22.08391. CONFIDENTIALITY OF INFORMATION. (a)
141141 Information collected about a person to comply with this
142142 subchapter, including the person's name, address, phone number,
143143 social security number, driver's license number, other
144144 identification number, and fingerprint records:
145145 (1) may not be released except:
146146 (A) to comply with this subchapter;
147147 (B) by court order; or
148148 (C) with the consent of the person who is the
149149 subject of the information;
150150 (2) is not subject to disclosure as provided by
151151 Chapter 552, Government Code; and
152152 (3) shall be destroyed by the requestor or any
153153 subsequent holder of the information not later than the first
154154 anniversary of the date the information is received.
155155 (b) Any criminal history record information received by the
156156 State Board for Educator Certification as provided by this
157157 subchapter is subject to Section 411.090(b), Government Code.
158158 (c) Any criminal history record information received by the
159159 agency as provided by this subchapter is subject to Section
160160 411.0901(b), Government Code.
161161 (d) Any criminal history record information received by a
162162 school district, charter school, private school, regional
163163 education service center, commercial transportation company, or
164164 education shared services arrangement or an entity that contracts
165165 to provide services to a school district, charter school, or shared
166166 services arrangement as provided by this subchapter is subject to
167167 Section 411.097(d), Government Code.
168168 SECTION 6. The change in law made by this Act applies to
169169 information collected, assembled, or maintained before, on, or
170170 after the effective date of this Act.
171171 SECTION 7. This Act takes effect immediately if it receives
172172 a vote of two-thirds of all the members elected to each house, as
173173 provided by Section 39, Article III, Texas Constitution. If this
174174 Act does not receive the vote necessary for immediate effect, this
175175 Act takes effect September 1, 2009.
