10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Sections 13.503(c) and (d), Water Code, are | |
12 | 12 | amended to read as follows: | |
13 | 13 | (c) In addition to the charges permitted under Subsection | |
14 | 14 | (b), the rules shall authorize the owner or manager of a | |
15 | 15 | manufactured home rental community or apartment house [owner or | |
16 | 16 | manager] to impose a service charge of not more than nine percent of | |
17 | 17 | the costs related to submetering allocated to each submetered | |
18 | 18 | rental or dwelling unit. | |
19 | 19 | (d) For purposes of Subsection (c), "costs related to | |
20 | 20 | submetering" means water costs as well as any other applicable | |
21 | 21 | taxes and surcharges that are charged by the retail public utility | |
22 | 22 | to the owner or manager of a manufactured home rental community or | |
23 | 23 | apartment house [owner or manager]. | |
24 | 24 | SECTION 2. This Act takes effect September 1, 2009. |
