55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study of the provision of retail electric service and
88 the regulation of components of the electric utilities industry.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. (a) The Public Utility Commission of Texas shall
1111 conduct a study of the conditions under which electric service is
1212 provided to retail customers in this state.
1313 (b) The state energy conservation office shall assist the
1414 commission as requested.
1515 (c) The study must examine:
1616 (1) prices and reliability of retail electric service
1717 in this state, including a comparison of prices and degrees of
1818 reliability of service in:
1919 (A) urban and rural areas of this state;
2020 (B) different geographic regions of this state;
2121 and
2222 (C) regulated and deregulated retail electric
2323 service areas of this state;
2424 (2) prices and degrees of reliability of retail
2525 electric service in this state as compared to the prices and degrees
2626 of reliability of service in other states with regulated,
2727 deregulated, or mixed regulated and deregulated retail electric
2828 service; and
2929 (3) factors related to differences in prices and
3030 degrees of reliability of retail electric service shown by
3131 comparisons made under Subdivisions (1) and (2) of this subsection,
3232 including:
3333 (A) differences in the generation and
3434 transmission of electric power among various urban, rural,
3535 regulated, and deregulated areas, including:
3636 (i) differences in the ages of generating
3737 and transmission facilities prevalent in the areas considered;
3838 (ii) differences in the types of generation
3939 and transmission technologies prevalent in the areas considered;
4040 (iii) differences in fuel types used for
4141 generation of electric power in the areas considered; and
4242 (iv) other factors the commission considers
4343 relevant, including economies of scale, power transmission
4444 distances, rates of adoption of distributed generation
4545 technologies and renewable energy technologies for electric power
4646 generation, rates of adoption of demand response, load management,
4747 and energy efficiency measures; and
4848 (B) differences in the structure of retail
4949 electric service markets among various urban, rural, regulated, and
5050 deregulated areas.
5151 SECTION 2. The Public Utility Commission of Texas, as part
5252 of the study conducted under this Act, shall examine and compare the
5353 history of retail electric service prices and degrees of
5454 reliability in the following states:
5555 (1) Arizona;
5656 (2) Arkansas;
5757 (3) California;
5858 (4) Illinois;
5959 (5) Montana;
6060 (6) Nevada;
6161 (7) New Mexico;
6262 (8) Ohio;
6363 (9) Oregon;
6464 (10) Pennsylvania;
6565 (11) Virginia; and
6666 (12) any other state that has pursued retail electric
6767 service restructuring to provide for customer choice but that
6868 subsequently has significantly amended its laws on the subject.
6969 SECTION 3. (a) The Public Utility Commission of Texas,
7070 based on information collected and conclusions drawn from the study
7171 conducted under Sections 1 and 2 of this Act, shall develop
7272 alternative retail electric service market restructuring plans
7373 under which retail electric service in this state or in certain
7474 areas of this state may be made the most affordable and reliable. A
7575 plan developed under this section must include specific legislative
7676 or rulemaking proposals necessary or convenient to implement the
7777 plan.
7878 (b) A plan developed under Subsection (a) of this section
7979 may provide for re-regulation of one or more components of the
8080 retail electric service market in one or more areas of this state in
8181 which customer choice has been implemented.
8282 (c) The Public Utility Commission of Texas, based on
8383 information collected and conclusions drawn from the study
8484 conducted under Sections 1 and 2 of this Act, shall determine
8585 whether retail electric service in those areas of this state in
8686 which customer choice has not been implemented will likely be more
8787 affordable and reliable if customer choice is delayed or not
8888 implemented. The commission shall make recommendations for any
8989 necessary legislative or rulemaking action the commission
9090 determines would make retail electric service the most affordable
9191 and reliable in those areas.
9292 SECTION 4. (a) The Public Utility Commission of Texas shall
9393 prepare a report on the information collected and conclusions drawn
9494 as a result of the study conducted under Sections 1 and 2 of this Act
9595 and the recommendations made under Section 3 of this Act as a result
9696 of the study.
9797 (b) The Public Utility Commission of Texas shall:
9898 (1) present the report prepared under this section to:
9999 (A) the governor;
100100 (B) the lieutenant governor;
101101 (C) the speaker of the house of representatives;
102102 and
103103 (D) each standing or interim committee of the
104104 legislature that has jurisdiction over the commission or a
105105 component of retail electric service provision in this state; and
106106 (2) publish the report on the commission's Internet
107107 website for public access.
108108 SECTION 5. This Act takes effect immediately if it receives
109109 a vote of two-thirds of all the members elected to each house, as
110110 provided by Section 39, Article III, Texas Constitution. If this
111111 Act does not receive the vote necessary for immediate effect, this
112112 Act takes effect September 1, 2009.
