77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Article 38.43, Code of Criminal Procedure, is
99 amended by adding Subsection (f) to read as follows:
1010 (f)(1) This subsection applies only to evidence described
1111 by Subsection (b) that was used to prosecute and convict a defendant
1212 of an offense under Chapter 19, 21, or 22, Penal Code, if on
1313 conviction of the offense the defendant was sentenced to a term of
1414 imprisonment of 10 years or more.
1515 (2) In a county with a population less than 100,000,
1616 the attorney representing the state, clerk, or other officer in
1717 possession of any evidence to which this subsection applies shall
1818 ensure the preservation of the evidence by promptly delivering the
1919 evidence to the Department of Public Safety for storage in
2020 accordance with Section 411.052, Government Code, and department
2121 rules.
2222 SECTION 2. Subchapter D, Chapter 411, Government Code, is
2323 amended by adding Section 411.052 to read as follows:
2424 Sec. 411.052. PRESERVATION OF EVIDENCE CONTAINING
2525 BIOLOGICAL MATERIAL. (a) The department:
2626 (1) shall maintain a storage space for the
2727 preservation of evidence containing biological material that is
2828 delivered to the department under Article 38.43(f), Code of
2929 Criminal Procedure; and
3030 (2) may maintain a storage space for the preservation
3131 of evidence of a sexual assault or other sex offense.
3232 (b) The department shall adopt rules relating to the
3333 delivery, cataloging, and preservation of evidence stored under
3434 this section.
3535 SECTION 3. (a) The Department of Public Safety of the State
3636 of Texas shall adopt rules as required by Section 411.052(b),
3737 Government Code, as added by this Act, not later than November 1,
3838 2009.
3939 (b) The Department of Public Safety of the State of Texas
4040 must begin accepting evidence delivered to the department in
4141 accordance with Article 38.43, Code of Criminal Procedure, as
4242 amended by this Act, and Section 411.052, Government Code, as added
4343 by this Act, on January 1, 2010.
4444 SECTION 4. The change in law made by this Act applies to the
4545 storage of evidence in the possession of the state during a criminal
4646 proceeding that commences on or after January 1, 2010. The storage
4747 of evidence in the possession of the state during a criminal
4848 proceeding that commences before January 1, 2010, is covered by the
4949 law in effect when the proceeding commenced, and the former law is
5050 continued in effect for that purpose.
5151 SECTION 5. This Act does not make an appropriation. A
5252 provision in this Act that creates a new governmental program,
5353 creates a new entitlement, or imposes a new duty on a governmental
5454 entity is not mandatory during a fiscal period for which the
5555 legislature has not made a specific appropriation to implement the
5656 provision.
5757 SECTION 6. This Act takes effect September 1, 2009.
